  1  1    Section 1.  Section 53.40, unnumbered paragraph 2, Code
  1  2 2003, is amended to read as follows:
  1  3    Unless the request specifies otherwise, a request for the
  1  4 primary election shall also be considered a request for the
  1  5 general election.  In the case of the general election For all
  1  6 elections, request may be made not more than seventy days
  1  7 before the election, for and on behalf of a voter in the armed
  1  8 forces of the United States by a spouse, parent, parent-in-
  1  9 law, adult brother, adult sister, or adult child of the voter,
  1 10 residing in the county of the voter's residence.  However, a
  1 11 request made by other than the voter may be required to be
  1 12 made on forms prescribed by the state commissioner.  
  1 13                           EXPLANATION
  1 14    This bill provides that a family member, specified by law,
  1 15 may make a request for an absentee ballot on behalf of a voter
  1 16 in the armed forces of the United States for any election.
  1 17 Current law allows requests by proxy for a member of the armed
  1 18 forces only for the general election.
