PAG LIN 1 1 Section 1. Section 147.80, subsection 16, Code 2003, is 1 2 amended to read as follows: 1 3 16. License to practice barbering on the basis of an 1 4 examination given by the board of barber examiners, license to 1 5 practice barbering under a reciprocal agreement, renewal of a 1 6 license to practice barbering, annual inspection by the 1 7 department of inspections and appeals of barber school and 1 8 annual inspection of barber shop, an original barber school 1 9 license, renewal of a barber school license, transfer of 1 10 license upon change of ownership of a barber shop or barber 1 11 school, inspection by the department of inspections and 1 12 appeals and an original barber shop license, renewal of a 1 13 barber shop license, original barber school instructor's 1 14 license, renewal of a barber school instructor's license, and 1 15 registration as an apprentice barber. 1 16 Sec. 2. Section 158.3, subsection 3, Code 2003, is amended 1 17 to read as follows: 1 18 3. Notwithstanding the provisions of subsection 1, 1 19 paragraph "a", any person who is registered as a barber's 1 20 apprenticeon the effective date of this chapter may apply to1 21the department prior to October 1, 1976 and shall be issued a1 22license to practice barbering upon payment of the fee1 23prescribed under the provisions of section 147.80, and has 1 24 successfully completed an apprentice program for barbers 1 25 established pursuant to section 158.3A, shall be deemed to 1 26 have satisfied the course of study requirement for licensure. 1 27 Sec. 3. NEW SECTION. 158.3A APPRENTICE PROGRAM FOR 1 28 BARBERS REGISTRATION. 1 29 1. The department shall establish an apprentice program 1 30 for barbers. The program shall consist of a minimum of six 1 31 months of practical experience in the practice of barbering 1 32 under the direct supervision of a licensed barber. 1 33 2. An applicant for the apprentice program for barbers 1 34 shall register with the board and pay a registration fee 1 35 established as provided in section 147.80. The applicant 2 1 shall submit a statement from a supervising barber verifying 2 2 the prospective apprenticeship and agreeing to terms of 2 3 supervision and periodic evaluation of the apprentice as 2 4 prescribed by the board by rule. 2 5 Sec. 4. Section 158.8, Code 2003, is amended to read as 2 6 follows: 2 7 158.8 COURSE OF STUDY. 2 8 The course of study of a barber school shall consist of at 2 9 leasttwoone thousandoneeight hundred hours of instruction 2 10 as prescribed by the board and shall include instruction in 2 11 all phases of the practice of barbering as defined in section 2 12 158.1, subsection 1. The course shall require at leastten2 13 twelve months of instruction for completion. The course shall 2 14 include not less thanthreesix hundred hours of 2 15 demonstrations and lectures in the following areas:Lawlaw; 2 16 ethics; equipment; shop management; history of barbering; 2 17 sanitation; sterilization; personal hygiene; first aid; 2 18 bacteriology; anatomy; scalp, skin, hair and their common 2 19 disorders; electricity as applied to barbering; chemistry and 2 20 pharmacology; scalp care; hair body processing; hairpieces; 2 21honing and stropping; shaving;facials, massage and packs; 2 22 haircutting; hair tonics; dyeing and bleaching; instruments; 2 23 soaps; and shampoos, creams, lotions, and tonics. It shall 2 24 include not less than one thousandfour hundredtwo hundred 2 25 hours of supervised practical instruction in the following 2 26 areas:Scalpscalp care and shampooing,honing and stropping,2 27shaving,haircutting, hairstyling and blow waving, dyeing and 2 28 bleaching, hair body processing, facials, massage and packs, 2 29 beard and mustache trimming, and hairpieces. 2 30 A person licensed under section 157.3 who enrolls in a 2 31 barber school shall be granted full credit for each course 2 32 successfully completed which meets the requirements of the 2 33 barber school, which shall be credited toward thetwoone 2 34 thousandoneeight hundred hour requirement, and theten-month2 35 twelve-month period does not apply. A person who has been a 3 1 student in a school of cosmetology arts and sciences licensed 3 2 under chapter 157 may enroll in a barber school and shall be 3 3 granted, at the discretion of the school, at least half credit 3 4 and up to full credit for each course successfully completed 3 5 which meets the requirements of the barber school. 3 6 Sec. 5. Section 158.12, Code 2003, is amended to read as 3 7 follows: 3 8 158.12 LICENSE SUSPENSION AND REVOCATION. 3 9 Any license or registration issued by the department under 3 10the provisions ofthis chapter may be suspended, revoked, or 3 11 renewal denied by the board for violation ofany provision of3 12 chapter 157 or this chapter or rulespromulgatedadopted by 3 13 the boardunder the provisions ofpursuant to chapter 17A. 3 14 Sec. 6. Section 158.13, subsection 1, Code 2003, is 3 15 amended to read as follows: 3 16 1. It is unlawful for a person to employ an individual to 3 17 practice barbering unless that individual is a licensed barber 3 18 or has obtained a temporary permit. It is unlawful for a 3 19 person to employ an individual as an apprentice barber unless 3 20 that individual is registered pursuant to section 158.3A. It 3 21 is unlawful for a licensed barber to practice barbering with 3 22 or without compensation in any place other than a licensed 3 23 barbershop or barber school, or a licensed salon as defined in 3 24 section 157.1, except that a licensed barber may practice 3 25 barbering at a location which is not a licensed barbershop or 3 26 barber school under extenuating circumstances arising from 3 27 physical or mental disability or death of a customer. It is 3 28 unlawful for a licensed barber to claim to be a licensed 3 29 cosmetologist, but it is lawful for a licensed barber to work 3 30 in a licensed salon. 3 31 Sec. 7. Section 272C.2A, Code 2003, is amended to read as 3 32 follows: 3 33 272C.2A CONTINUING EDUCATION MINIMUM REQUIREMENTS 3 34 BARBERING AND COSMETOLOGY ARTS AND SCIENCES. 3 35 1. The board of barber examiners and the board of 4 1 cosmetology arts and sciences examiners, created pursuant to 4 2 chapter 147, shall each require, as a condition of license 4 3 renewal, a minimum of six hours of continuing education in the 4 4 two years immediately prior to a licensee's license renewal. 4 5 The board of cosmetology arts and sciences examiners may 4 6 notify cosmetology arts and sciences licensees on a quarterly 4 7 basis regarding continuing education opportunities. 4 8 2. Notwithstanding subsection 1, a licensed barber shall 4 9 be exempt from additional continuing education requirements as 4 10 a condition of license renewal if the licensee has 4 11 continuously held a license to practice barbering in this 4 12 state and been engaged in the practice of barbering in this 4 13 state during the twenty-year period immediately preceding the 4 14 licensure renewal date. 4 15 EXPLANATION 4 16 This bill provides for modifications relating to barbering 4 17 licensure requirements and establishes an apprentice program 4 18 for barbers. 4 19 The bill provides that the course of study required for 4 20 licensure as a barber shall consist of 1,800 hours of 4 21 coursework, at least 1,200 hours of which shall be spent in 4 22 supervised practical instruction. Previously, these 4 23 requirements were 2,100 and 1,400 hours, respectively. The 4 24 bill also provides for a twelve-month completion interval for 4 25 course of study requirements, increased from the current ten- 4 26 month requirement, and makes specified adjustments in the 4 27 number of hours of lecture, demonstration, and practical 4 28 supervision to be provided. The bill also provides that the 4 29 course of study requirement shall not apply if an applicant 4 30 for licensure has successfully completed an apprentice program 4 31 for barbers. 4 32 The bill provides that an apprentice program for barbers 4 33 shall be established by the department of public health, and 4 34 shall consist of a minimum of six months of practical 4 35 experience in the practice of barbering under the direct 5 1 supervision of a licensed barber. The bill provides that an 5 2 applicant for the apprentice program for barbers shall 5 3 register with the board and pay a registration fee established 5 4 by the board. The bill provides that the applicant shall 5 5 submit a statement from a supervising barber verifying the 5 6 prospective apprenticeship and agreeing to terms of 5 7 supervision and periodic evaluation. The bill makes 5 8 conforming changes to Code chapter 158 relating to 5 9 establishment of the apprentice program for barbers, and 5 10 eliminates instruction related to licensure requirements. 5 11 The bill provides that the license suspension and 5 12 revocation provisions of Code section 158.12, and the 5 13 provisions specifying violations contained in Code section 5 14 158.13, shall be applicable to apprentice barbers. 5 15 The bill additionally provides for an exemption from 5 16 continuing education requirements as a condition of license 5 17 renewal for barbers under specified circumstances. The bill 5 18 provides that a barber shall be exempt from continuing 5 19 education requirements if the barber has continuously held a 5 20 license to practice barbering in Iowa and been engaged in the 5 21 practice of barbering in Iowa during the 20-year period 5 22 immediately preceding the licensure renewal date. 5 23 LSB 2358HH 80 5 24 rn/cl/14 5 25
