PAG LIN 1 1 HOUSE FILE 204 1 2 1 3 AN ACT 1 4 RELATING TO MASSAGE THERAPY BY PROVIDING FOR A STUDY REGARDING 1 5 THE MODALITIES ASSOCIATED WITH MASSAGE THERAPY AND PROVIDING 1 6 A TEMPORARY EXEMPTION FROM LICENSURE REQUIREMENTS. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. NEW SECTION. 152C.5A MASSAGE THERAPY 1 11 MODALITIES STUDY. 1 12 The Iowa department of public health, with input from the 1 13 board, shall conduct a study regarding the modalities 1 14 associated with the practice of massage therapy. The study 1 15 shall be conducted with the input of licensed massage 1 16 therapists, reflexologists, and unlicensed persons practicing 1 17 modalities related to massage therapy. The objective of the 1 18 study shall be to determine which modalities shall be included 1 19 under the definition of massage therapy and require licensure, 1 20 and shall include, but not be limited to, a recommendation 1 21 regarding the licensure of reflexologists. The study shall 1 22 focus on the health, safety, and welfare of the public 1 23 regarding each of the modalities reviewed. The department 1 24 shall submit a report summarizing the results of the study and 1 25 making recommendations regarding modality inclusion to the 1 26 general assembly by January 15, 2004. 1 27 Sec. 2. NEW SECTION. 152C.7A TEMPORARY EXEMPTIONS. 1 28 An individual who is engaged exclusively in the practice of 1 29 reflexology or an unlicensed individual who is practicing a 1 30 modality related to massage therapy, and whose professional 1 31 practice does not incorporate aspects that constitute massage 1 32 therapy as defined in section 152C.1, shall not be subject to 1 33 the licensure provisions of this chapter for a one-year period 1 34 beginning July 1, 2003, and ending June 30, 2004. Beginning 1 35 July 1, 2004, an individual who is engaged exclusively in the 2 1 practice of reflexology or an unlicensed individual who is 2 2 practicing a modality related to massage therapy shall be 2 3 subject to licensure pursuant to this chapter unless, based 2 4 upon the recommendations contained in the massage therapy 2 5 modalities study as provided in section 152C.5A, the practice 2 6 of reflexology or an unlicensed individual who is practicing a 2 7 modality related to massage therapy is permanently exempted 2 8 from massage therapy licensure. 2 9 2 10 2 11 2 12 CHRISTOPHER C.
