1 4 REQUIRING MOTOR VEHICLE OPERATORS TO TAKE CERTAIN PRECAUTIONS
1 5 WHEN PASSING STATIONARY UTILITY MAINTENANCE OR MUNICIPAL
1 6 MAINTENANCE VEHICLES AND MAKING A PENALTY APPLICABLE.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 321.323A, subsection 2, Code 2003, is
1 11 amended to read as follows:
1 12 2. The operator of a motor vehicle approaching a
1 13 stationary towing or recovery vehicle, a stationary utility
1 14 maintenance vehicle, a stationary municipal maintenance
1 15 vehicle, or a stationary highway maintenance vehicle, that is
1 16 displaying flashing yellow, amber, or red lights, shall
1 17 approach the vehicle with due caution and shall proceed in one
1 18 of the following manners, absent any other direction by a
1 19 peace officer:
1 20 a. Make a lane change into a lane not adjacent to the
1 21 towing, recovery, utility maintenance, municipal maintenance,
1 22 or highway maintenance vehicle if possible in the existing
1 23 safety and traffic conditions.
1 24 b. If a lane change under paragraph "a" would be
1 25 impossible, prohibited by law, or unsafe, reduce the speed of
1 26 the motor vehicle to a reasonable and proper speed for the
1 27 existing road and traffic conditions, which speed shall be
1 28 less than the posted speed limit, and be prepared to stop.
