1 1 Section 1. Section 42.4, subsection 8, Code 2003, is
1 2 amended by striking the subsection and inserting in lieu
1 3 thereof the following:
1 4 8. Each bill embodying a plan drawn under this section
1 5 shall include provisions for election of senators to the
1 6 general assemblies which take office in the years ending in
1 7 one, three, and five, which shall be in conformity with
1 8 article III, section 6, of the Constitution of the State of
1 9 Iowa. The provisions shall be substantially as follows:
1 10 a. Each senator's term of office shall be terminated on
1 11 January 1 of the year ending in three.
1 12 b. Within thirty days following enactment of a plan of
1 13 legislative redistricting as provided by this chapter, the
1 14 chief justice of the Iowa supreme court shall decide, by lot,
1 15 whether those persons seeking election to the general assembly
1 16 which takes office in the year ending in three from odd-
1 17 numbered senate districts are to be elected to a term of
1 18 office of four years or two years. The chief justice shall
1 19 notify the secretary of state of this determination in
1 20 writing.
1 21 EXPLANATION
1 22 This bill provides for the election of senators following
1 23 legislative redistricting. The bill provides that the term of
1 24 office of each state senator shall terminate on January 1 of
1 25 each year ending in three. The bill further provides that
1 26 within 30 days following enactment of a plan of legislative
1 27 redistricting, the chief justice of the Iowa supreme court
1 28 shall determine, by lot, whether odd-numbered senatorial
1 29 districts shall elect a senator for the general assembly
1 30 starting in the year ending in three to a four-year or two-
1 31 year term. The chief justice shall notify the secretary of
1 32 state of this determination in writing.
