1 1 Amend the Senate amendment, H-8568, to House File
1 2 2302, as amended, passed, and reprinted by the House,
1 3 as follows:
1 4 #1. Page 28, by inserting after line 37 the
1 5 following:
1 6 "Sec. . LICENSE ISSUANCE REQUIREMENTS – FIFTY-
1 7 MILE LIMIT. If an application for issuance of a new
1 8 license to conduct gambling games as provided by
1 9 chapter 99F is submitted to the commission after July
1 10 1, 2004, and the application is for a facility to be
1 11 located within fifty miles of a facility to which a
1 12 license to conduct pari-mutuel wagering at a horse
1 13 racetrack enclosure has been issued by July 1, 2004,
1 14 the licensee of the existing facility shall be offered
1 15 the right to apply for and to be issued the license
1 16 for the facility proposed in the application prior to
1 17 issuance of the license to the nonlicensee applicant."
