  1  1    Amend Senate File 2298, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 133, by inserting after line 5 the
  1  4 following:
  1  5    "Sec. ___.  Section 232.141, subsection 1, Code
  1  6 2003, is amended to read as follows:
  1  7    1.  Except as otherwise provided by law, the court
  1  8 shall inquire into the ability of the child or the
  1  9 child's parent to pay expenses incurred pursuant to
  1 10 subsection subsections 2, and subsection 4, and, after
  1 11 8.  After giving the parent a reasonable opportunity
  1 12 to be heard, the court may order the parent to pay all
  1 13 or part of the costs of the child's care, examination,
  1 14 treatment, legal expenses, or other expenses.  An
  1 15 order entered under this section does not obligate a
  1 16 parent paying child support under a custody decree,
  1 17 except that part of the monthly support payment may be
  1 18 used to satisfy the obligations imposed by the order
  1 19 entered pursuant to this section.  If a parent fails
  1 20 to pay as ordered, without good reason, the court may
  1 21 proceed against the parent for contempt and may inform
  1 22 the county attorney who shall proceed against the
  1 23 parent to collect the unpaid amount.  Any payment
  1 24 ordered by the court shall be a judgment against each
  1 25 of the child's parents and a lien as provided in
  1 26 section 624.23.  If all or part of the amount that the
  1 27 parents are ordered to pay is subsequently paid by the
  1 28 county or state, the judgment and lien shall
  1 29 thereafter be against each of the parents in favor of
  1 30 the county to the extent of the county's payments and
  1 31 in favor of the state to the extent of the state's
  1 32 payments.
  1 33    Sec. ___.  Section 234.39, Code 2003, is amended by
  1 34 adding the following new subsection:
  1 35    NEW SUBSECTION.  6.  A support obligation for a
  1 36 shelter care placement shall be determined under
  1 37 section 232.141."
