1 3 #1. Page 65, by inserting after line 6 the
1 4 following:
1 5 "Sec. . Section 262.56, Code 2003, is amended
1 6 to read as follows:
1 7 262.56 AUTHORIZATION – CONTRACTS – TITLE.
1 8 1. Subject to and in accordance with the
1 9 provisions of this division the state board of regents
1 10 is hereby authorized to undertake and carry out any
1 11 project as hereinbefore defined at the state
1 12 University of Iowa, Iowa State University of science
1 13 and technology and the University of Northern Iowa and
1 14 to operate, control, maintain and manage student
1 15 residence halls and dormitories, including dining and
1 16 other incidental facilities, and additions to such
1 17 buildings at each of said institutions. All contracts
1 18 for the construction, reconstruction, completion,
1 19 equipment, improvement, repair or remodeling of any
1 20 buildings, additions or facilities shall be let in
1 21 accordance with the provisions of section 262.34. The
1 22 title to all real estate acquired under the provisions
1 23 of this division and the improvements erected thereon
1 24 shall be taken and held in the name of the state of
1 25 Iowa. The board is authorized to rent the rooms in
1 26 such residence halls and dormitories to the students,
1 27 officers, guests and employees of said institutions at
1 28 such rates, fees or rentals as will provide a
1 29 reasonable return upon the investment, but which will
1 30 in any event produce net rents, profits and income
1 31 sufficient to insure the payment of the principal of
1 32 and interest on all bonds or notes issued to pay any
1 33 part of the cost of any project and refunding bonds or
1 34 notes issued pursuant to the provisions of this
1 35 division.
1 36 2. The state board of regents shall prohibit the
1 37 institutions of higher education under its control
1 38 from specifically setting aside any percentage of
1 39 available residence hall or dormitory space
1 40 specifically for the purposes of housing students who
1 41 are interested in, or are participating in, sexuality
1 42 studies or programs."
