1 4 "Sec. . NEW SECTION. 135.105D VOLUNTARY LEAD
1 5 HAZARD REMEDIATION – LIABILITY.
1 6 1. The department shall adopt rules, pursuant to
1 7 chapter 17A, setting forth voluntary lead hazard
1 8 remediation standards for an owner or managing agent
1 9 of target housing or a child-occupied facility
1 10 constructed prior to 1978. In promulgating these
1 11 rules, the department shall consult with state
1 12 associations of real estate agents and landlords.
1 13 2. The department shall also adopt rules, pursuant
1 14 to chapter 17A, setting forth the conditions under
1 15 which an owner or managing agent of target housing or
1 16 a child-occupied facility constructed prior to 1978
1 17 who has voluntarily completed lead hazard remediation
1 18 and who is sued by a current or former occupant
1 19 seeking damages for injuries allegedly arising from
1 20 exposure to lead-based paint hazards shall be immune
1 21 from liability.
1 22 3. The department shall adopt rules, pursuant to
1 23 chapter 17A, to develop and administer a central
1 24 registry of target housing or child-occupied
1 25 facilities constructed prior to 1978 that meet the
1 26 lead hazard remediation standards promulgated by the
1 27 department pursuant to subsection 1. The department
1 28 shall establish by rule fees in amounts sufficient to
1 29 defray the costs of administering the central
1 30 registry. Fees received shall be considered repayment
1 31 receipts as defined in section 8.2. The department
1 32 shall consider providing internet access to the
1 33 registry.
1 34 4. For purposes of this section, "child-occupied
1 35 facility", "lead-based paint hazard", and "target
1 36 housing" shall mean the same as defined in
1 37 departmental rules."
