1 1 Amend House File 2552 as follows:
1 2 #1. Page 2, by inserting after line 9 the
1 3 following:
1 4 "Sec. . Section 321.34, subsection 10,
1 5 paragraph d, Code Supplement 2003, is amended to read
1 6 as follows:
1 7 d. For purposes of this subsection, a person is
1 8 considered to be retired if the person is recognized
1 9 by the chief of the fire department where the
1 10 individual served, and on record, as officially
1 11 retired from the fire department. Special
1 12 registration plates with a fire fighter emblem shall
1 13 be surrendered, as provided in subsection 12, in
1 14 exchange for regular registration plates upon
1 15 termination of the motor vehicle owner's membership in
1 16 the paid or volunteer fire department, unless the
1 17 person is a retired member in good standing. The
1 18 surviving spouse of a person who was issued special
1 19 plates under this subsection may continue to use or
1 20 apply for and use the special plates subject to
1 21 registration of the special plates in the surviving
1 22 spouse's name and upon payment of the annual
1 23 registration fee."
1 24 #2. Page 5, by striking line 1 and inserting the
1 25 following:
1 26 "Sec. . EFFECTIVE AND RETROACTIVE APPLICABILITY
1 27 DATES.
1 28 1. This Act,".
1 29 #3. Page 5, line 3, by inserting after the word
1 30 "applies" the following: "retroactively".
1 31 #4. Page 5, by inserting after line 4 the
1 32 following:
1 33 "2. The section of this Act amending section
1 34 321.34, subsection 10, paragraph "d", applies
1 35 retroactively to March 1, 2004. Notwithstanding the
1 36 provision of this Act that repeals section 321.34,
1 37 subsection 10, effective upon enactment, the state
1 38 department of transportation shall administer the
1 39 special fire fighter plates as though the amendment to
1 40 section 321.34, subsection 10, paragraph "d", had
1 41 taken effect prior to the repeal of section 321.34,
1 42 subsection 10."
1 43 #5. By renumbering as necessary.
