1 20 "Sec. 101. SALE OF BACKBONE ASSETS – INITIAL
1 21 RIGHT TO SUBMIT OFFER. An incumbent local exchange
1 22 utility shall have a right of first refusal or initial
1 23 right to submit an offer with regard to any Part II
1 24 section of the network backbone that terminates within
1 25 the utility's service territory. An incumbent local
1 26 exchange utility shall have ninety days from the date
1 27 of issuance of a request for proposals pursuant to
1 28 section 3 of this Act to notify the authority of the
1 29 utility's intention to submit a purchase offer. A
1 30 purchase offer submitted pursuant to this section
1 31 shall be subject to the approval of the authority,
1 32 after the verification process as provided for in
1 33 section 4 of this Act. In the event that the ninety-
1 34 day period elapses without an offer submitted by an
1 35 incumbent local exchange utility, or an offer is not
1 36 approved, the authority shall proceed with selection
1 37 of a professional agent pursuant to section 3 of this
1 38 Act. All incumbent local exchange utilities
1 39 submitting approved offers shall share the Part I dark
1 40 fiber capacity, provide access to authorized users of
1 41 the network, and provide for the associated costs of
1 42 maintenance of the Part I section of the network
1 43 backbone."
