1 2 #1. Page 5, by inserting after line 11 the
1 3 following:
1 4 "Sec. . SALE OF ASSETS – AUTHORITY PLAN. The
1 5 authority shall establish a plan for the sale of the
1 6 backbone assets conditioned upon the continued use of
1 7 the network by school districts, community colleges,
1 8 libraries, area education agencies, and state
1 9 agencies. Sale of the backbone assets shall be
1 10 conditioned upon a written assurance by the purchaser
1 11 or purchasers that the fees charged for network usage
1 12 by these entities shall not be increased for a ten-
1 13 year period and any fee increases after the ten-year
1 14 period has elapsed shall be reasonable and affordable.
1 15 The terms of the sale of the assets shall expressly
1 16 provide that the authority is not authorized to enter
1 17 into a contract in which the sale of the backbone
1 18 assets will result in any loss of federal funds due to
1 19 the common carrier status of the network."
1 20 #2. Page 12, by inserting after line 26 the
1 21 following:
1 22 "Sec. . Section 8D.9, subsection 2, Code
1 23 Supplement 2003, is amended by striking the
1 24 subsection."
1 25 #3. By renumbering as necessary.
