  1  1    Amend Senate File 2208, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 4, by inserting after line 3 the
  1  4 following:  
  1  5                      "DIVISION    
  1  6                     MILK REGULATION
  1  7    Sec.    .  Section 192.101A, unnumbered paragraph
  1  8 1, Code Supplement 2003, is amended to read as
  1  9 follows:
  1 10    As used in this chapter, all terms shall have the
  1 11 same meaning as defined in the "Grade 'A' Pasteurized
  1 12 Milk Ordinance, 2001 Revision" Ordinance" as provided
  1 13 in section 192.102.  However, notwithstanding the
  1 14 ordinance, the following definitions shall apply:
  1 15    Sec.    .  Section 192.102, Code Supplement 2003,
  1 16 is amended to read as follows:
  1 17    192.102  GRADE "A" PASTEURIZED MILK ORDINANCE.
  1 18    The department shall adopt, by rule, the "Grade 'A'
  1 19 Pasteurized Milk Ordinance, 2001 2003 Revision",
  1 20 including a subsequent revision of the ordinance.  If
  1 21 the ordinance specifies that compliance with a
  1 22 provision of the ordinance's appendices is mandatory,
  1 23 the department shall also adopt that provision.  The
  1 24 department shall not amend the ordinance, unless the
  1 25 department explains each amendment and reasons for the
  1 26 amendment in the Iowa administrative bulletin when the
  1 27 rules are required to be published pursuant to chapter
  1 28 17A.  The department shall administer this chapter
  1 29 consistent with the provisions of the ordinance.
  1 30    Sec.    .  Section 192.110, subsection 1, Code
  1 31 Supplement 2003, is amended to read as follows:
  1 32    1.  The person has a pasteurized milk and milk
  1 33 products sanitation compliance rating of ninety
  1 34 percent or more as calculated according to the rating
  1 35 system as contained in the federal public health
  1 36 service publications, "Procedures Governing the
  1 37 Cooperative State-Public Health Service/Food and Drug
  1 38 Administration Program for Certification of Interstate
  1 39 Milk Shippers 2001" 2003" and "Method of Making
  1 40 Sanitation Ratings of Milk Supplies, 2001 2003
  1 41 Revision".  The applicable provisions of these
  1 42 publications are incorporated into this section by
  1 43 this reference.  A copy of each publication shall be
  1 44 on file with the department or in the office of the
  1 45 person subject to an inspection contract as provided
  1 46 in section 192.108."
