  1  1    Amend House File 2394 as follows:
  1  2    #1.  Page 3, by inserting after line 28 the
  1  3 following:
  1  4    "Sec.    .  Section 321.194, subsection 1,
  1  5 paragraph a, subparagraph (1), Code 2003, is amended
  1  6 to read as follows:
  1  7    (1)  During the hours of 6 a.m. to 10 p.m. over the
  1  8 most direct and accessible route between the
  1  9 licensee's residence and schools of enrollment and
  1 10 between schools of enrollment for the purpose of
  1 11 attending duly scheduled courses of instruction and
  1 12 extracurricular activities within the school district.
  1 13 For purposes of this section, "school" means a public
  1 14 school or an accredited or nonaccredited private
  1 15 school.
  1 16    Sec.    .  Section 321.194, subsection 1, paragraph
  1 17 b, unnumbered paragraph 1, Code 2003, is amended to
  1 18 read as follows:
  1 19    Each application shall be accompanied by a
  1 20 statement from the school board, superintendent, or
  1 21 principal, if authorized by the superintendent, of the
  1 22 applicant's school or, if the applicant attends a
  1 23 private school, by the governing authority of the
  1 24 private school.  The statement shall be upon a form
  1 25 provided by the department.  The school board,
  1 26 superintendent, or principal, if authorized by the
  1 27 superintendent, or governing authority shall certify
  1 28 that a need exists for the license and that the board,
  1 29 superintendent, or principal authorized by the
  1 30 superintendent, or governing authority is not
  1 31 responsible for actions of the applicant which pertain
  1 32 to the use of the driver's license.  Upon receipt of a
  1 33 statement of necessity, the department shall issue the
  1 34 driver's license.  The fact that the applicant resides
  1 35 at a distance less than one mile from the applicant's
  1 36 school of enrollment is prima facie evidence of the
  1 37 nonexistence of necessity for the issuance of a
  1 38 license.  The school board of directors of a public
  1 39 school district shall develop and adopt a policy
  1 40 establishing the criteria that shall be used by a
  1 41 school district administrator to approve or deny
  1 42 certification that a need exists for a license.  The
  1 43 student enrolled in a public school may appeal to the
  1 44 school board the decision of a school district
  1 45 administrator to deny certification.  The decision of
  1 46 the school board is final.  The driver's license shall
  1 47 not be issued for purposes of attending a public
  1 48 school in a school district other than either of the
  1 49 following:"
  1 50    #2.  Title page, line 1, by inserting after the
  2  1 word "parent" the following:  "and issuance of special
  2  2 driver's licenses to minors".
