1 2 #1. Page 49, by inserting after line 5, the
1 3 following:
1 4 "Sec. . 2003 Iowa Acts, House File 619, section
1 5 7, subsection 4, paragraph b, if enacted, is amended
1 6 to read as follows:
1 7 b. Pharmacies and providers that are enrolled in
1 8 the medical assistance program shall make available
1 9 drug acquisition cost information, product
1 10 availability information, and other information deemed
1 11 necessary by the department for the determination of
1 12 reimbursement rates and the efficient operation of the
1 13 pharmacy benefit. Pharmacies and providers shall
1 14 produce and submit the requested information in the
1 15 manner and format requested by the department or its
1 16 designee at no cost to the department or designee.
1 17 Pharmacies and providers shall submit information to
1 18 the department or its designee within thirty days
1 19 following receipt of a request for information unless
1 20 the department or its designee grants an extension
1 21 upon written request of the pharmacy or provider.
1 22 Notwithstanding the required provision of information
1 23 by pharmacies and providers under this paragraph, if
1 24 the department is able to obtain any of the
1 25 information required to be provided under this
1 26 paragraph in an alternative manner, through which the
1 27 department is ensured of the validity and accuracy of
1 28 the information and of the timely submission of the
1 29 information, the department may instead obtain the
1 30 information in the alternative manner. Chapter 550
1 31 shall apply to the information provided by pharmacies
1 32 and providers under this paragraph."
