  1  1    Amend Senate File 452, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 18, by inserting after line 30 the
  1  4 following:  
  1  5                      "DIVISION ___
  1  6                    CASH RESERVE FUND
  1  7    Sec.    .  If House File 696 is enacted during the 2003
  1  8 Regular Session of the Eightieth General Assembly, any additional
  1  9 revenues from the state taxation of the adjusted gross revenues
  1 10 from gambling games at racetrack enclosures which result from the
  1 11 enactment of House File 696 and which are deposited into the
  1 12 rebuild Iowa infrastructure fund shall be transferred to the cash
  1 13 reserve fund in an amount not to exceed $16,555,000."
  1 14    #2.  Page 20, by inserting after line 9 the following:
  1 15                      "DIVISION ___
  1 16                CONTINGENT APPROPRIATIONS
  1 17    Sec.    .  The appropriations made from the rebuild
  1 18 Iowa infrastructure fund in division I of this Act and
  1 19 from the environment first fund in division II of this
  1 20 Act are contingent upon the occurrence of one or both
  1 21 of the following:
  1 22    1.  The enactment of House File 696 during the 2003
  1 23 Regular Session of the Eightieth General Assembly.
  1 24    2.  A final decision by the United States Supreme
  1 25 Court in the litigation entitled Racing Association of
  1 26 Central Iowa v. Fitzgerald, 648 N.W.2d 555 (Iowa 2002)
  1 27 in favor of the state's taxation pursuant to section
  1 28 99F.11, Code 2003, of the adjusted gross revenues from
  1 29 gambling games at racetrack enclosures."
