  1  1    Amend Senate File 440, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, by striking line 3 and inserting the
  1  4 following:
  1  5    "1.  For the school budget year beginning July 1,
  1  6 2004, and".
  1  7    #2.  Page 1, by inserting after line 20 the
  1  8 following:
  1  9    "2.  This section is repealed June 30, 2004.
  1 10    Sec.    .  NEW SECTION.  285.17  NONPUBLIC SCHOOL
  1 11 TRANSPORTATION – STATE AID TERMINATION.
  1 12    The provisions of this chapter relating to general
  1 13 fund appropriations for nonpublic school
  1 14 transportation costs and reimbursements shall be
  1 15 applicable solely for the school budget year beginning
  1 16 July 1, 2003.  For the school budget year beginning
  1 17 July 1, 2004, and succeeding budget years, nonpublic
  1 18 schools shall be responsible for school transportation
  1 19 costs and the reimbursement of transportation
  1 20 expenses.
  1 21    Sec.    .  Section 301.1, subsection 2, Code 2003,
  1 22 is amended to read as follows:
  1 23    2.  Textbooks adopted and purchased by a school
  1 24 district shall, to the extent funds are appropriated
  1 25 by the general assembly, be made available to pupils
  1 26 attending accredited nonpublic schools upon request of
  1 27 the pupil or the pupil's parent under comparable terms
  1 28 as made available to pupils attending public schools.
  1 29 If the general assembly appropriates moneys for
  1 30 purposes of making textbooks available to accredited
  1 31 nonpublic school pupils, the department of education
  1 32 shall ascertain the amount available to a school
  1 33 district for the purchase of nonsectarian,
  1 34 nonreligious textbooks for pupils attending accredited
  1 35 nonpublic schools.  The amount shall be in the
  1 36 proportion that the basic enrollment of a
  1 37 participating accredited nonpublic school bears to the
  1 38 sum of the basic enrollments of all participating
  1 39 accredited nonpublic schools in the state for the
  1 40 budget year.  For purposes of this section, a
  1 41 "participating accredited nonpublic school" means an
  1 42 accredited nonpublic school that submits a written
  1 43 request on behalf of the school's pupils in accordance
  1 44 with this subsection, and that certifies its actual
  1 45 enrollment to the department of education by October
  1 46 1, annually.  By October 15, annually, the department
  1 47 of education shall certify to the director of revenue
  1 48 and finance the annual amount to be paid to each
  1 49 school district, and the director of revenue and
  1 50 finance shall draw warrants payable to school
  2  1 districts in accordance with this subsection.  For
  2  2 purposes of this subsection, an accredited nonpublic
  2  3 school's enrollment count shall include only students
  2  4 who are residents of Iowa.  The costs of providing
  2  5 textbooks to accredited nonpublic school pupils as
  2  6 provided in this subsection shall not be included in
  2  7 the computation of district cost under chapter 257,
  2  8 but shall be shown in the budget as an expense from
  2  9 miscellaneous income.  Textbook expenditures made in
  2 10 accordance with this subsection shall be kept on file
  2 11 in the school district.  This subsection is repealed
  2 12 June 30, 2004."

  2 15 for a future repeal".
