1 5 LEASED STATE PROPERTY
1 6 Sec. . Section 427.1, subsection 1, Code 2003,
1 7 is amended to read as follows:
1 8 1. FEDERAL AND STATE PROPERTY. The property of
1 9 the United States and this state, including state
1 10 university, university of science and technology, and
1 11 school lands, except as otherwise provided in this
1 12 subsection. The exemption herein provided shall not
1 13 include any real property subject to taxation under
1 14 any federal statute applicable thereto, but such
1 15 exemption shall extend to and include all machinery
1 16 and equipment owned exclusively by the United States
1 17 or any corporate agency or instrumentality thereof
1 18 without regard to the manner of the affixation of such
1 19 machinery and equipment to the land or building upon
1 20 or in which such property is located, until such time
1 21 as the Congress of the United States shall expressly
1 22 authorize the taxation of such machinery and
1 23 equipment.
1 24 Sec. . Section 427.1, subsection 1, Code 2003,
1 25 is amended by adding the following new unnumbered
1 26 paragraph:
1 27 NEW UNNUMBERED PARAGRAPH. Property of the state
1 28 operated pursuant to section 904.302, 904.705, or
1 29 904.706 that is leased to an entity other than an
1 30 entity which is exempt from property taxation under
1 31 this section shall be subject to property taxation for
1 32 the term of the lease. Property taxes levied against
1 33 such leased property shall be paid from the revolving
1 34 farm fund created in section 904.706. The lessor
1 35 shall file a copy of the lease with the county
1 36 assessor of the county where the property is located.
1 37 Sec. . Section 904.302, Code 2003, is amended
1 38 by adding the following new subsection:
1 39 NEW SUBSECTION. 7A. Pay property taxes levied
1 40 against land leased by the department of corrections
1 41 or department of human services as provided in section
1 42 427.1, subsection 1.
1 43 Sec. . Section 904.705, unnumbered paragraph 2,
1 44 Code 2003, is amended to read as follows:
1 45 The director may with the assistance of the
1 46 department of natural resources establish and operate
1 47 forestry nurseries on state-owned land under the
1 48 control of the department. Residents of the adult
1 49 correctional institutions shall provide the labor for
1 50 the operation. Nursery stock shall be sold in
2 1 accordance with the rules of the natural resource
2 2 commission. The department shall pay the costs of
2 3 establishing and operating the forestry nurseries out
2 4 of the revolving farm fund created in section 904.706.
2 5 The department of natural resources shall pay the
2 6 costs of transporting, sorting, and distributing
2 7 nursery stock to and from or on state-owned land under
2 8 the control of the department of natural resources.
2 9 Receipts from the sale of nursery stock produced under
2 10 this section shall be divided between the department
2 11 and the department of natural resources in direct
2 12 proportion to their respective costs as a percentage
2 13 of the total costs. However, property taxes due and
2 14 payable on the land shall be deducted before receipts
2 15 of sale are divided between the two departments if
2 16 land subject to this section is leased to an entity
2 17 other than an entity which is exempt from property
2 18 taxation under section 427.1. The department shall
2 19 deposit its receipts in the revolving farm fund
2 20 created in section 904.706.
2 21 Sec. . APPLICABILITY. This division of this
2 22 Act applies to leases entered into on or after July 1,
2 23 2003."
