  1  1    Amend the amendment, H-1215, to House File 598 as
  1  2 follows:
  1  3    #1.  Page 2, by inserting after line 15 the
  1  4 following:
  1  5    "Sec.    .  NEW SECTION.  321J.2D  PERSONS FOUND
  1  6 NOT GUILTY – INSURANCE.
  1  7    Notwithstanding any other provision to the
  1  8 contrary, if any prosecution for a violation of
  1  9 section 321J.2 or 321J.2A does not result in a
  1 10 conviction, an insurance company that has increased
  1 11 the defendant's insurance premium due to the
  1 12 prosecution of a violation of section 321J.2 or
  1 13 321J.2A shall reimburse the defendant any insurance
  1 14 premium collected by the insurance company which is in
  1 15 excess of the defendant's insurance premium prior to
  1 16 the prosecution."
  1 17    #2.  Page 4, line 8, by inserting before the word
  1 18 "changing" the following:  "requiring reimbursement of
  1 19 insurance premiums upon a finding of not guilty in an
  1 20 operating-while-intoxicated prosecution,".
  1 21    #3.  By renumbering as necessary.
