  1  1    Amend the amendment, H-1216, to House File 619 as
  1  2 follows:
  1  3    #1.  By striking page 2, line 37, through page 4,
  1  4 line 32.
  1  5    #2.  By striking page 4, line 42, through page 5,
  1  6 line 3, and inserting the following:
  1  7    "2.  a.  A medical assistance pharmaceutical and
  1  8 therapeutics committee shall be established within the
  1  9 department by July 1, 2003, for the purpose of
  1 10 developing and providing ongoing review of the
  1 11 preferred drug list.
  1 12    b.  (1)  The members of the committee shall be
  1 13 appointed by the governor and shall include health
  1 14 care professionals who possess recognized knowledge
  1 15 and expertise in one or more of the following:
  1 16    (a)  The clinically appropriate prescribing of
  1 17 covered outpatient drugs.
  1 18    (b)  The clinically appropriate dispensing and
  1 19 monitoring of covered outpatient drugs.
  1 20    (c)  Drug use review, evaluation, and intervention.
  1 21    (d)  Medical quality assurance.
  1 22    (2)  The membership of the committee shall be
  1 23 comprised of at least one third but not more than
  1 24 fifty-one percent licensed and actively practicing
  1 25 physicians and at least one third licensed and
  1 26 actively practicing pharmacists.
  1 27    c.  The members shall be appointed to terms of two
  1 28 years.  Members may be appointed to more than one
  1 29 term.  The department shall provide staff support to
  1 30 the committee.  Committee members shall select a
  1 31 chairperson and vice chairperson annually from the
  1 32 committee membership."
  1 33    #3.  Page 5, by striking lines 27 through 29, and
  1 34 inserting the following:  "that if a medical
  1 35 assistance program recipient was prescribed a mental
  1 36 health-related drug, an antiretroviral drug, or a drug
  1 37 related to the treatment of transplantation or cancer,
  1 38 prior to the implementation of the".
  1 39    #4.  Page 6, by striking lines 25 and 26, and
  1 40 inserting the following:  "legislative fiscal
  1 41 committee on a quarterly basis."
  1 42    #5.  Page 9, by inserting after line 6 the
  1 43 following:
  1 44    "e.  The department shall report any savings
  1 45 realized through the SMAC program to the legislative
  1 46 fiscal committee on a monthly basis."
  1 47    #6.  Page 9, by striking lines 35 through 38, and
  1 48 inserting the following:  "paragraph "a", subparagraph
  1 49 (2), if projected state fund expenditures for
  1 50 reimbursement of nursing facilities for the fiscal
  2  1 year beginning July 1, 2003, in".
  2  2    #7.  Page 9, line 41, by inserting before the words
  2  3 "the department" the following:  "exceeds
  2  4 $147,252,856,".
  2  5    #8.  Page 9, by striking line 44, and inserting the
  2  6 following:  "projected."
  2  7    #9.  Page 11, by inserting after line 11 the
  2  8 following:
  2  9    "3.  The department of human services shall, in any
  2 10 compilation of data or other report distributed to the
  2 11 public concerning payments to providers under the
  2 12 medical assistance program, set forth reimbursements
  2 13 to physicians of the university of Iowa college of
  2 14 medicine through supplemental adjustments as a
  2 15 separate item and shall not include such payments in
  2 16 the amounts otherwise reported as the reimbursement to
  2 17 a physician for services to medical assistance
  2 18 recipients."
  2 19    #10.  Page 12, by inserting after line 20, the
  2 20 following:
  2 21    "___.  The portion of the section of this Act
  2 22 relating to the state maximum allowable cost (SMAC)
  2 23 program, being deemed of immediate importance, takes
  2 24 effect upon enactment."
