1 46 It is the intent of the general assembly that the
1 47 university continue progress on the school of public
1 48 health and the public health initiative for the
1 49 purposes of establishing an accredited school of

2 1 health and independence of elderly Iowans. From the
2 2 funds appropriated in this lettered paragraph, the
2 3 university may use up to $2,100,000 for the school of
2 4 public health and the public health initiative.

2 7 miscellaneous purposes and for medical and surgical
2 8 treatment of indigent patients as provided in chapter
2 9 255, for medical education, and for not more than the

2 13 The university of Iowa hospitals and clinics shall,
2 14 within the context of chapter 255 and when medically
2 15 appropriate, make reasonable efforts to extend the
2 16 university of Iowa hospitals and clinics' use of home
2 17 telemedicine and other technologies to reduce the
2 18 frequency of visits to the hospital required by
2 19 indigent patients. The university of Iowa hospitals
2 20 and clinics shall submit a report to the general
2 21 assembly and the legislative fiscal bureau by January
2 22 15, 2004, describing its use of these technologies to
2 23 accomplish this purpose.
2 24 The university of Iowa hospitals and clinics shall
2 25 submit quarterly a report regarding the portion of the
2 26 appropriation in this lettered paragraph expended on
2 27 medical education. The report shall be submitted in a
2 28 format jointly developed by the university of Iowa
2 29 hospitals and clinics, the legislative fiscal bureau,
2 30 and the department of management, and shall delineate
2 31 the expenditures and purposes of the funds.
2 32 Funds appropriated in this lettered paragraph shall
2 33 not be used to perform abortions except medically
2 34 necessary abortions, and shall not be used to operate
2 35 the early termination of pregnancy clinic except for
2 36 the performance of medically necessary abortions. For
2 37 the purpose of this lettered paragraph, an abortion is
2 38 the purposeful interruption of pregnancy with the
2 39 intention other than to produce a live-born infant or
2 40 to remove a dead fetus, and a medically necessary
2 41 abortion is one performed under one of the following
2 42 conditions:
2 43 (1) The attending physician certifies that
2 44 continuing the pregnancy would endanger the life of
2 45 the pregnant woman.
2 46 (2) The attending physician certifies that the
2 47 fetus is physically deformed, mentally deficient, or
2 48 afflicted with a congenital illness.
2 49 (3) The pregnancy is the result of a rape which is
2 50 reported within 45 days of the incident to a law
3 1 enforcement agency or public or private health agency
3 2 which may include a family physician.
3 3 (4) The pregnancy is the result of incest which is
3 4 reported within 150 days of the incident to a law
3 5 enforcement agency or public or private health agency
3 6 which may include a family physician.
3 7 (5) The abortion is a spontaneous abortion,
3 8 commonly known as a miscarriage, wherein not all of
3 9 the products of conception are expelled.
3 10 The total quota allocated to the counties for
3 11 indigent patients for the fiscal year beginning July
3 12 1, 2003, shall not be lower than the total quota
3 13 allocated to the counties for the fiscal year
3 14 commencing July 1, 1998. The total quota shall be
3 15 allocated among the counties on the basis of the 2000
3 16 census pursuant to section 255.16.
