1 1 Amend Senate File 390, as amended, passed, and
1 2 reprinted by the Senate, as follows:
1 3 #1. Page 21, by inserting after line 23, the
1 4 following:
1 5 "Sec. . Section 331.303, Code 2003, is amended
1 6 by adding the following new subsection:
1 7 NEW SUBSECTION. 8A. Upon petition of twenty
1 8 percent of the eligible electors residing in the area
1 9 outside the city limits over which the zoning
1 10 jurisdiction is extended, approve or disapprove
1 11 pursuant to section 414.23 a city zoning ordinance or
1 12 regulation or an amendment to such an ordinance or
1 13 regulation affecting such area."
1 14 #2. Page 22, by inserting after line 2, the
1 15 following:
1 16 "Sec. . Section 414.23, unnumbered paragraph 3,
1 17 Code 2003, is amended to read as follows:
1 18 Property owners affected by such zoning regulations
1 19 shall have the same rights of hearing, protest, and
1 20 appeal as those within the municipality exercising
1 21 this power. However, upon petition of twenty percent
1 22 of the eligible electors residing in the area outside
1 23 the city limits over which the zoning jurisdiction is
1 24 extended, the city zoning ordinance or regulation, or
1 25 amendment to such an ordinance or regulation, shall
1 26 not take effect within such area unless the zoning
1 27 ordinance or regulation, or the amendment to such an
1 28 ordinance or regulation, is approved by the board of
1 29 supervisors. The petition shall be submitted to the
1 30 county auditor. The auditor shall notify the city of
1 31 receipt of the petition."
1 32 #3. Page 22, line 8, by inserting after the word
1 33 "Act" the following: "and applies to a city zoning
1 34 ordinance or regulation or an amendment to a city
1 35 ordinance or regulation affecting an unincorporated
1 36 area of a county over which a city has extended its
1 37 jurisdiction, which is adopted on or after the
1 38 effective date of this Act".
1 39 #4. Title page, line 10, by inserting after the
1 40 word "committees," the following: "authorizing a
1 41 county board of supervisors to approve or disapprove
1 42 certain city zoning ordinances or regulations,".
1 43 #5. By renumbering as necessary.
