1 2 #1. Page 5, by inserting after line 26 the
1 3 following:
1 4 "Sec. . NEW SECTION. 509.20 NOTICE OF RATE
1 5 INCREASE.
1 6 1. For purposes of this section, "policy or
1 7 contract for group health benefit coverages, including
1 8 a contract to provide services to a plan providing
1 9 group health benefit coverages" applies to all of the
1 10 following:
1 11 a. A group policy of health insurance under this
1 12 chapter.
1 13 b. A plan established pursuant to chapter 509A for
1 14 public employees.
1 15 c. A plan offered pursuant to chapter 513B.
1 16 d. A group contract of a nonprofit health service
1 17 corporation under chapter 514.
1 18 e. A group plan of a health maintenance
1 19 organization under chapter 514B.
1 20 f. An organized delivery system authorized under
1 21 1993 Iowa Acts, chapter 158, and licensed by the
1 22 director of public health.
1 23 g. Preferred provider contracts limiting choice of
1 24 specific provider.
1 25 h. Any other policy, contract, or plan for
1 26 covering the health care costs of a defined group.
1 27 2. A person who issues a policy or contract for
1 28 group health benefit coverages, including a contract
1 29 to provide services to a plan providing group health
1 30 benefit coverages to a group, shall provide notice of
1 31 a rate increase for the policy or contract at least
1 32 forty-five days prior to the effective date of the
1 33 rate increase to the policyholder, contract holder, or
1 34 sponsor of the group health benefit plan.
1 35 3. A person who issues a policy or contract for
1 36 group health benefit coverages, including a contract
1 37 to provide services to a plan providing group health
1 38 benefit coverages to a group, shall provide notice of
1 39 cancellation of the policy or contract at least forty-
1 40 five days prior to the effective date of the rate
1 41 increase to the policyholder, contract holder, or
1 42 sponsor of the group health benefit plan."
1 43 #2. Page 12, by inserting after line 20 the
1 44 following:
1 45 "Sec. . Section 514.6, Code 2003, is amended to
1 46 read as follows:
1 47 514.6 RATES – APPROVAL BY COMMISSIONER – NOTICE
1 48 OF INCREASE.
1 49 1. The rates charged by any such corporation to
1 50 the subscribers for health care service shall at all
2 1 times be subject to the approval of the commissioner
2 2 of insurance.
2 3 2. A corporation offering health care services to
2 4 subscribers pursuant to this chapter shall provide
2 5 notice of a rate increase to subscribers at least
2 6 forty-five days prior to the effective date of the
2 7 rate increase.
2 8 3. A corporation offering health care services to
2 9 subscribers pursuant to this chapter shall provide
2 10 notice of cancellation to a subscriber at least forty-
2 11 five days prior to the effective date of the
2 12 cancellation."
2 13 #3. By renumbering, redesignating, and correcting
2 14 internal references as necessary.
