  1 41    "Sec.    .  Section 97.51, subsection 1, Code 2003,
  1 42 is amended to read as follows:
  1 43    1.  The treasurer of state is the custodian and
  1 44 trustee of this fund and shall administer the fund in
  1 45 accordance with the directions of the department of
  1 46 personnel Iowa public employees' retirement system
  1 47 created in section 97B.1.  It is the duty of the
  1 48 trustee:
  1 49    a.  To hold said trust funds.
  1 50    b.  Under the direction of the department and as
  2  1 designated by the department, invest such portion of
  2  2 said trust funds as are not needed for current payment
  2  3 of benefits, in interest-bearing securities issued by
  2  4 the United States, or interest-bearing bonds issued by
  2  5 the state of Iowa, or bonds issued by counties, school
  2  6 districts or general obligations or limited levy bonds
  2  7 issued by municipal corporations in this state as
  2  8 authorized by law; also to sell and dispose of same
  2  9 when needed for the payment of benefits.
  2 10    c.  To disburse the trust funds upon warrants drawn
  2 11 by the director of revenue and finance pursuant to the
  2 12 order of the department of personnel Iowa public
  2 13 employees' retirement system created in section 97B.1.
  2 14    Sec. ___.  Section 97.51, subsection 3, Code 2003,
  2 15 is amended to read as follows:
  2 16    3.  The department of personnel Iowa public
  2 17 employees' retirement system created in section 97B.1
  2 18 shall administer the Iowa old-age and survivors'
  2 19 insurance liquidation fund and shall also administer
  2 20 all other provisions of this chapter.
  2 21    Sec. ___.  Section 97.52, Code 2003, is amended to
  2 22 read as follows:
  2 23    97.52  ADMINISTRATION AGREEMENTS.
  2 24    The department of personnel Iowa public employees'
  2 25 retirement system created in section 97B.1 may enter
  2 26 into agreements whereby services performed by the
  2 27 department system and its employees under chapters 97,
  2 28 97B, and 97C shall be equitably apportioned among the
  2 29 funds provided for the administration of those
  2 30 chapters.  The money spent for personnel, rentals,
  2 31 supplies, and equipment used by the department system
  2 32 in administering the chapters shall be equitably
  2 33 apportioned and charged against the funds."
  2 34    #13.  Page 137, by inserting after line 20 the
  2 35 following:
  2 36    "Sec. ___.  Section 97C.2, subsection 8, Code 2003,
  2 37 is amended to read as follows:
  2 38    8.  The term "state agency" means the department of
  2 39 personnel Iowa public employees' retirement system
  2 40 created in section 97B.1."
  2 41    #14.  Page 177, by inserting after line 28 the
  2 42 following:
  2 43    "Sec. ___.  STATE ADMINISTRATIVE SERVICES –
  2 44 MISCELLANEOUS PROVISIONS.
  2 45    1.  As used in this section, unless the context
  2 46 otherwise requires:
  2 47    a.  "Designated state service" means one of the
  2 48 following services provided to state agencies:
  2 49 printing, information technology, mail, human resource
  2 50 benefits and payroll, financial accounting, property
  3  1 management, fleet management, and purchasing services.
  3  2    b.  "Managed competition" means a process that
  3  3 allows both state government entities and nonstate
  3  4 government entities to submit competitive bids to
  3  5 provide designated state services, which process takes
  3  6 into account the true cost-accounting costs for state
  3  7 government entities and may result in multiple
  3  8 providers of the same designated state service.  The
  3  9 use of managed competition shall not preclude the use
  3 10 of other entrepreneurial steps in any area.
  3 11    2.  a.  The department of administrative services
  3 12 may, pursuant to the requirements of this section,
  3 13 determine how the designated state services of all
  3 14 executive branch agencies, community-based corrections
  3 15 districts, and other state governmental entities shall
  3 16 be delivered.  In addition, the state board of regents
  3 17 shall participate in any determination of the
  3 18 department of administrative services on the delivery
  3 19 of designated state services as provided by this
  3 20 section but only if both the department and state
  3 21 board of regents approve such participation.
  3 22    b.  This section shall not apply to the judicial
  3 23 branch, legislative branch, statewide elected
  3 24 officials, area education agencies, and community
  3 25 colleges.
  3 26    3.  The following duties relating to state
  3 27 administrative services shall be performed as provided
  3 28 by this subsection.
  3 29    a.  By July 1, 2004, the department of
  3 30 administrative services shall submit a request for
  3 31 proposals for a managed competition for printing
  3 32 services.  The request for proposals shall allow for
  3 33 the awarding of all or parts of printing services to
  3 34 the department or another governmental agency or
  3 35 nongovernmental entity.
  3 36    b.  Subject to the requirements provided in chapter
  3 37 8A, the department of administrative services shall
  3 38 determine the means of delivery for all information
  3 39 technology services, including determining which
  3 40 services shall remain the responsibility of individual
  3 41 state agencies.  The department shall determine which
  3 42 application development activities shall remain as
  3 43 responsibilities of the individual state agencies.  As
  3 44 of July 1, 2003, all employees delivering information
  3 45 technology services shall be transferred to the
  3 46 department of administrative services or applicable
  3 47 delivering agency and any funding appropriated for
  3 48 such services shall also be transferred, as determined
  3 49 by the department of management.
  3 50    c.  The three major data centers of state
  4  1 government shall be physically merged into one data
  4  2 center as expeditiously as possible, no later than
  4  3 July 1, 2004.
  4  4    d.  The department of administrative services may
  4  5 limit unified fleet management responsibilities to
  4  6 cars and small trucks.  By July 1, 2005, the fleet
  4  7 management operations shall be subject to a managed
  4  8 competition process conducted by the department of
  4  9 administrative services.  Any one-time savings shall
  4 10 be amortized based on state government's average
  4 11 borrowing cost for funds over the preceding five
  4 12 years.
  4 13    4.  The auditor of state shall be consulted
  4 14 regarding the decision to conduct a managed
  4 15 competition process under this section for each
  4 16 designated state service and shall also be consulted
  4 17 regarding the issuance of a request for proposals and
  4 18 shall also be consulted in the award process.  The
  4 19 auditor of state's role is to provide advice as to
  4 20 whether an approach offers the best opportunity for
  4 21 reducing state government costs.
  4 22    5.  The department of administrative services shall
  4 23 submit a written report to the legislative government
  4 24 oversight committee by December 31, 2003, concerning
  4 25 the progress made by the department in complying with
  4 26 the requirements of this section as well as any other
  4 27 suggestions or recommendations of the department
  4 28 concerning the requirements of this section."
