  1  1    Amend the amendment, H-1066, to House File 549 as
  1  2 follows:
  1  3    #1.  Page 1, line 4, by striking the figure "12"
  1  4 and inserting the following:  "6".
  1  5    #2.  Page 1, by striking lines 7 and 8 and
  1  6 inserting the following:
  1  7    "NEW PARAGRAPH.  r.  Who is twelve years of age or
  1  8 older and violates a mediation agreement or refuses to
  1  9 participate in mediation pursuant to section 299.5A."
  1 10    #3.  Page 1, by striking lines 9 through 16.
  1 11    #4.  Page 1, by striking lines 19 through 38.
  1 12    #5.  Page 2, by striking lines 1 and 2, and
  1 13 inserting the following:  "mediation under section
  1 14 299.5A, probable cause exists to believe that the
  1 15 child is a child in need of assistance pursuant to
  1 16 section 232.2, subsection 6, paragraph "r".
  1 17    Sec.    .  Section 299.8, Code 2003, is amended to
  1 18 read as follows:
  1 19    299.8  "TRUANT" DEFINED.
  1 20    Any child of compulsory attendance age who fails to
  1 21 attend school as provided in this chapter, or as
  1 22 required by the school board's or school governing
  1 23 body's attendance policy, or who fails to attend
  1 24 competent private instruction under chapter 299A,
  1 25 without reasonable excuse for the absence, shall be
  1 26 deemed to be a truant.  A finding that a child is
  1 27 truant, however, shall not by itself mean that the
  1 28 child is a child in need of assistance within the
  1 29 meaning of chapter 232 and shall not be the sole basis
  1 30 for a child in need of assistance petition."
  1 31    #6.  By renumbering as necessary.
