  1  1    Amend House File 549 as follows:
  1  2    #1.  Page 1, by inserting before line 1, the
  1  3 following:
  1  4    "Section 1.  Section 256.7, subsection 24, Code
  1  5 2003, is amended to read as follows:
  1  6    24.  Adopt rules on or before January 1, 2001, to
  1  7 require school districts and accredited nonpublic
  1  8 schools to adopt local policies relating to health
  1  9 services, media services programs, and guidance
  1 10 programs, as part of the general accreditation
  1 11 standards applicable to school districts pursuant to
  1 12 section 256.11.  This subsection shall be applicable
  1 13 strictly for reporting purposes and shall not be
  1 14 interpreted to require school districts and accredited
  1 15 nonpublic schools to provide or offer health services,
  1 16 media services programs, or guidance programs."
  1 17    #2.  Page 1, by inserting after line 31, the
  1 18 following:
  1 19    "Sec.    .  Section 256.11, Code 2003, is amended
  1 20 by adding the following new subsection:
  1 21    NEW SUBSECTION.  9.  Unless a waiver has been
  1 22 obtained under section 256.11A, each accredited
  1 23 nonpublic school or school district shall have the
  1 24 following:
  1 25    a.  A media center in each attendance center
  1 26 accessible to students throughout the school day and a
  1 27 qualified school media services specialist who meets
  1 28 the licensing standards prescribed by the board of
  1 29 educational examiners and who is responsible for media
  1 30 center supervision.
  1 31    b.  An articulated sequential elementary-secondary
  1 32 guidance program for grades kindergarten through
  1 33 twelve and a guidance counselor who meets the
  1 34 licensing standards prescribed by the board of
  1 35 educational examiners.
  1 36    In determining the requirements of this subsection
  1 37 for an accredited nonpublic school, the department
  1 38 shall evaluate the accredited nonpublic school on an
  1 39 accredited nonpublic school system basis rather than
  1 40 on an individual accredited nonpublic school basis.
  1 41    Sec.    .  Section 256.11A, subsection 1, Code
  1 42 2003, is amended to read as follows:
  1 43    1.  Schools Accredited nonpublic schools and school
  1 44 districts unable to meet the standard adopted by the
  1 45 state board requiring each school or school district
  1 46 operating a kindergarten through grade twelve program
  1 47 to provide an articulated sequential elementary-
  1 48 secondary guidance program may, not later than August
  1 49 1, 1995 2003, for the school year beginning July 1,
  1 50 1995 2003, file a written request to the department of
  2  1 education that the department waive one or more of the
  2  2 requirement for requirements established in section
  2  3 256.11, subsection 9, that an accredited nonpublic
  2  4 school or school district have a media center and a
  2  5 qualified school media services specialist and that an
  2  6 accredited nonpublic school or school district
  2  7 operating a kindergarten through grade twelve program
  2  8 provide an articulated sequential elementary-secondary
  2  9 guidance program.  The procedures specified in
  2 10 subsection 3 apply to the request.  Not later than
  2 11 August 1, 1996 2004, for the school year beginning
  2 12 July 1, 1996 2004, the board of directors of a school
  2 13 district or the authorities in charge of a nonpublic
  2 14 school may request a one-year extension of the waiver.
  2 15    Sec.    .  Section 256.11A, subsection 2, Code
  2 16 2003, is amended by striking the subsection."
  2 17    #3.  Page 20, by inserting after 19, the following:
  2 18    "Sec.    .  STATE MANDATE FUNDING SPECIFIED.  In
  2 19 accordance with section 25B.2, subsection 3, the state
  2 20 cost of requiring compliance with any state mandate
  2 21 included in this Act shall be paid by a school
  2 22 district from state school foundation aid received by
  2 23 the school district under section 257.16.  This
  2 24 specification of the payment of the state cost shall
  2 25 be deemed to meet all the state funding-related
  2 26 requirements of section 25B.2, subsection 3, and no
  2 27 additional state funding shall be necessary for the
  2 28 full implementation of this Act by and enforcement of
  2 29 this Act against all affected school districts."
