  1  1    Amend House File 65 as follows:
  1  2    #1.  Page 1, by inserting after line 25 the
  1  3 following:
  1  4    "Sec.    .  NEW SECTION.  321J.2C  PERSONS FOUND
  1  5 NOT GUILTY.
  1  6    1.  Notwithstanding any other provision of this
  1  7 chapter to the contrary, if any prosecution for a
  1  8 violation of section 321J.2 or 321J.2A does not result
  1  9 in a conviction, and the defendant's driver's license
  1 10 or nonresident operating privilege has been revoked
  1 11 under section 321J.9 or 321J.12 for the occurrence
  1 12 from which the arrest arose, the department shall,
  1 13 upon receipt of the court order finding the defendant
  1 14 not guilty, immediately rescind the revocation order
  1 15 and reinstate the defendant's license.
  1 16    2.  Notwithstanding section 321.12 or any other
  1 17 provision of chapter 321 or 321J to the contrary, the
  1 18 director shall immediately destroy any operating
  1 19 records pertaining to a revocation under section
  1 20 321J.9 or 321J.12 for the occurrence from which an
  1 21 arrest arose when the defendant was subsequently
  1 22 prosecuted and found not guilty upon receipt of the
  1 23 court order finding the defendant not guilty."
  1 24    #2.  Title page, line 1, by striking the words and
  1 25 figure "providing for a .08 blood alcohol
  1 26 concentration limit for" and inserting the following:
  1 27 "relating to".
  1 28    #3.  By renumbering as necessary.
