PAG LIN 1 1 Section 1. NEW SECTION. 135.17 MEANS-TESTED PROGRAMS 1 2 MOTOR VEHICLE FINANCIAL LIABILITY COVERAGE. 1 3 1. For purposes of this section, unless the context 1 4 otherwise requires, "means-tested program" means a program, 1 5 service, or other assistance for which a person's eligibility 1 6 or financial obligation for the program, service, or other 1 7 assistance involves consideration of the income available to 1 8 the person and includes but is not limited to any of the 1 9 following administered by the department: 1 10 a. The birth defects institute under chapter 136A, genetic 1 11 and metabolic screening, genetic counseling, and related or 1 12 similar services. 1 13 b. Child health services, including mobile and regional 1 14 child health specialty clinics, dental services, screening 1 15 programs, and other services to promote or address child 1 16 health. 1 17 c. Homemaker-home health aide program. 1 18 d. Maternal health clinics and services. 1 19 e. Public health nursing services. 1 20 f. Senior health program. 1 21 2. To the extent authorized under federal law and 1 22 regulation, for any means-tested program administered by the 1 23 department, the requirements for an individual's initial and 1 24 ongoing eligibility shall credit, disregard, deduct, or 1 25 otherwise exclude from income the amount expended by the 1 26 individual to comply with the motor vehicle financial 1 27 liability coverage requirements under section 321.20B. 1 28 Sec. 2. NEW SECTION. 216A.7 MEANS-TESTED PROGRAMS 1 29 MOTOR VEHICLE FINANCIAL LIABILITY COVERAGE. 1 30 1. For purposes of this section, unless the context 1 31 otherwise requires, "means-tested program" means a program, 1 32 service, or other assistance for which a person's eligibility 1 33 or financial obligation for the program, service, or other 1 34 assistance involves consideration of the income available to 1 35 the person. 2 1 2. To the extent authorized under federal law and 2 2 regulation, for any means-tested program administered by a 2 3 division of the department, the requirements for an 2 4 individual's initial and ongoing eligibility shall credit, 2 5 disregard, deduct, or otherwise exclude from income the amount 2 6 expended by the individual to comply with the motor vehicle 2 7 financial liability coverage requirements under section 2 8 321.20B. 2 9 Sec. 3. NEW SECTION. 217.35 MEANS-TESTED PROGRAMS 2 10 MOTOR VEHICLE FINANCIAL LIABILITY COVERAGE. 2 11 1. For purposes of this section unless the context 2 12 otherwise requires, "means-tested program" means a program, 2 13 service, or other assistance for which a person's eligibility 2 14 or financial obligation for the program, service, or other 2 15 assistance involves consideration of the income available to 2 16 the person and includes but is not limited to the following 2 17 administered by the department: 2 18 a. Child care assistance under section 237A.13. 2 19 b. Child support enforcement. 2 20 c. Family investment program under chapter 239B and 2 21 associated programs and services. 2 22 d. Medical assistance under chapter 249A. 2 23 e. State supplementary assistance under chapter 249. 2 24 2. To the extent authorized under federal law and 2 25 regulation, for any means-tested program administered by the 2 26 department, the requirements for an individual's initial and 2 27 ongoing eligibility shall credit, disregard, deduct, or 2 28 otherwise exclude from income the amount expended by the 2 29 individual to comply with the motor vehicle financial 2 30 liability coverage requirements under section 321.20B. 2 31 EXPLANATION 2 32 This bill relates to certain means-tested programs by 2 33 requiring exclusion of the cost of motor vehicle financial 2 34 liability coverage under Code section 321.20B in considering 2 35 an individual's initial and ongoing eligibility for the 3 1 program. 3 2 Code section 321.20B prohibits the driving of a motor 3 3 vehicle in this state unless the driver possesses a card or 3 4 other proof of financial liability coverage. The bill defines 3 5 the term "means-tested program" as any program, service, or 3 6 other assistance for which a person's eligibility or financial 3 7 obligation is determined based upon the consideration of the 3 8 person's income. For such programs, to the extent allowable 3 9 under federal requirements, an individual's expenditures to 3 10 comply with the proof of liability coverage law are to be 3 11 excluded from income in determining the individual's 3 12 eligibility or financial obligation. 3 13 The bill's provisions are applicable to the Iowa department 3 14 of public health in new Code section 135.17, to the divisions 3 15 of the department of human rights in new Code section 216A.7, 3 16 and to the department of human services in new Code section 3 17 217.35. The bill is applicable generally to means-tested 3 18 programs administered by those departments and, in addition, 3 19 particular programs are specified. 3 20 LSB 2011HH 79 3 21 jp/gg/8
