By striking everything after the enacting 1 4 clause and inserting the following: 1 5 "Section 1. Section 256.11, Code 1999, is amended 1 6 by adding the following new subsection: 1 7 NEW SUBSECTION. 9. Unless a waiver has been 1 8 obtained under section 256.11A, each accredited 1 9 nonpublic school or school district shall have all of 1 10 the following: 1 11 a. A media center in each attendance center 1 12 accessible to students throughout the school day and a 1 13 qualified school media services specialist who meets 1 14 the licensing standards prescribed by the board of 1 15 educational examiners and who is responsible for media 1 16 center supervision. 1 17 b. An articulated sequential elementary-secondary 1 18 guidance program for grades kindergarten through 1 19 twelve and a guidance counselor who meets the 1 20 licensing standards prescribed by the board of 1 21 educational examiners. 1 22 In determining the requirements of this subsection 1 23 for an accredited nonpublic school, the department 1 24 shall evaluate the accredited nonpublic school on an 1 25 accredited nonpublic school system basis rather than 1 26 on an individual accredited nonpublic school basis. 1 27 Sec. 2. Section 256.11, Code 1999, is amended by 1 28 adding the following new subsection: 1 29 NEW SUBSECTION. 9A. Each accredited nonpublic 1 30 school and school district shall adopt a policy for 1 31 the implementation of a school health services 1 32 program. The program shall be designed to help each 1 33 student protect, improve, and maintain the student's 1 34 physical, emotional, and social well-being, and shall 1 35 include a policy on the provision of special health 1 36 services as defined and established by rule. Areas to 1 37 be considered in the development of a policy may 1 38 include, but are not limited to, environmental health 1 39 and safety, emergency health procedures and 1 40 responsibilities, health promotion, communicable 1 41 disease prevention and control, staffing for the 1 42 school health program, administering of prescription 1 43 medication, acute or chronic health problems, health 1 44 assessment and screening, and recordkeeping and 1 45 program evaluation. 1 46 In determining the requirements of this subsection 1 47 for an accredited nonpublic school, the department 1 48 shall evaluate the accredited nonpublic school on an 1 49 accredited nonpublic school system basis rather than 1 50 on an individual accredited nonpublic school basis. 2 1 Sec. 3. Section 256.11A, subsection 1, Code 1999, 2 2 is amended to read as follows: 2 3 1.SchoolsAccredited nonpublic schools and school 2 4 districtsunable to meet the standard adopted by the2 5state board requiring each school or school district2 6operating a kindergarten through grade twelve program2 7to provide an articulated sequential elementary-2 8secondary guidance programmay, not later than August 2 9 1,19952000, for the school year beginning July 1, 2 1019952000, file a written request to the department of 2 11 education that the department waive one or more of the 2 12requirement forrequirements established in section 2 13 256.11, subsection 9, that an accredited nonpublic 2 14 school or school district have a media center and a 2 15 qualified school media services specialist and that an 2 16 accredited nonpublic school or school district 2 17 operating a kindergarten through grade twelve program 2 18 provide an articulated sequential elementary-secondary 2 19 guidance program. The procedures specified in 2 20 subsection 3 apply to the request. Not later than 2 21 August 1,19962001, for the school year beginning 2 22 July 1,19962001, the board of directors of a school 2 23 district or the authorities in charge of a nonpublic 2 24 school may request a one-year extension of the waiver. 2 25 Sec. 4. Section 256.11A, subsection 2, Code 1999, 2 26 is amended by striking the subsection. 2 27 Sec. 5. STATE MANDATE FUNDING SPECIFIED. In 2 28 accordance with section 25B.2, subsection 3, the state 2 29 cost of requiring compliance with any state mandate 2 30 included in this Act shall be paid by a school 2 31 district from state school foundation aid received by 2 32 the school district under section 257.16. This 2 33 specification of the payment of the state cost shall 2 34 be deemed to meet all the state funding-related 2 35 requirements of section 25B.2, subsection 3, and no 2 36 additional state funding shall be necessary for the 2 37 full implementation of this Act by and enforcement of 2 38 this Act against all affected school districts." 2 39 #2.
