PAG LIN 1 1 Section 1. Section 331.441, subsection 2, paragraph c, 1 2 Code 1999, is amended by adding the following new 1 3 subparagraph: 1 4 NEW SUBPARAGRAPH. (1A) A historical memorial or monument 1 5 erected for a purpose not otherwise provided for in 1 6 subparagraph (1), including the acquisition of ground and the 1 7 purchase, erection, construction, reconstruction, and 1 8 equipment of the memorial or monument. 1 9 Sec. 2. Section 356.5, subsection 6, Code 1999, is amended 1 10 to read as follows: 1 11 6. Keep amatronfemale jailer on the jail premises at all 1 12 times during the incarceration of one or more female 1 13 prisoners; keepeithera male jaileror matronon the premises 1 14 at all times during the incarceration of one or more male 1 15 prisoners, and make nighttime inspections while any prisoners 1 16 are confined, or provide for incarceration in a jail which 1 17 conforms to the provisions of this subsection. 1 18 Sec. 3. Section 441.6, unnumbered paragraph 2, Code 1999, 1 19 is amended to read as follows: 1 20 Upon receipt of the report of the examining board, the 1 21 chairperson of the conference board shall by written notice 1 22 call a meeting of the conference board to appoint an assessor. 1 23 The meeting shall be held not later than seven days after the 1 24 receipt of the report of the examining board by the conference 1 25 board. Thephysical condition, general reputation of the1 26applicants, and theirfitness of each applicant for the 1 27 position as determined by the examining board shall be taken 1 28 into consideration in making the appointment. At the meeting, 1 29 the conference board shall appoint an assessor from the 1 30 register of eligible candidates. However, if a special 1 31 examination has not been conducted previously for the same 1 32 vacancy, the conference board may request the director of 1 33 revenue and finance to hold a special examination pursuant to 1 34 section 441.7. The chairperson of the conference board shall 1 35 give written notice to the director of revenue and finance of 2 1 the appointment and its effective date within ten days of the 2 2 decision of the board. 2 3 Sec. 4. Section 456A.14, Code 1999, is amended to read as 2 4 follows: 2 5 456A.14 TEMPORARY APPOINTMENTS PEACE OFFICER STATUS. 2 6 The director may appoint temporary officers for a period 2 7 not to exceed six months and may adopt minimum job-related 2 8 physical, educational, mental, and moral requirements for the 2 9 temporary officers. Chapter 80B does not apply to the 2 10 temporary officers. Temporary officers have all the powers of 2 11 peace officers in the enforcement of this chapter and chapters 2 12 321G, 456B, 461A, 461B, 462A, 462B, 463B, 465C, 481A, 481B, 2 13 482, 483A, 484A, and 484B, and the trespass laws. 2 14 Sec. 5. Section 600B.1, Code 1999, is amended to read as 2 15 follows: 2 16 600B.1 OBLIGATION OF PARENTS. 2 17 The parents of a child born out of wedlock and not 2 18 legitimized (in this chapter referred to as "the child") owe 2 19 the child necessary maintenance, education, and support. They 2 20 are also liable for the child's funeral expenses. Thefather2 21isparents shall alsoliable to payshare in the expense of 2 22 the mother's pregnancy and confinement. The obligation of the 2 23 parent to support the child under the laws for the support of 2 24 poor relatives applies to children born out of wedlock. 2 25 Sec. 6. Section 600B.2, Code 1999, is amended to read as 2 26 follows: 2 27 600B.2 RECOVERY BYMOTHER FROM FATHERCUSTODIAL PARENT. 2 28 Themothercustodial parent may recover from thefather2 29 other parent a reasonable share of the necessary support of 2 30 the child. 2 31 Sec. 7. Section 600B.4, Code 1999, is amended to read as 2 32 follows: 2 33 600B.4 RECOVERY BY OTHERSTHAN MOTHER. 2 34 The obligation ofthe fathereither parent as hereby 2 35 provided creates also a cause of action on behalf of the legal 3 1 representative of themotherother parent, or on behalf of 3 2 third persons furnishing support or defraying the reasonable 3 3 expenses thereof, where paternity has been judicially 3 4 established by proceedings brought by the mother or by or on 3 5 behalf of the child or by the authorities charged with its 3 6 support, or where paternity has been acknowledged by the 3 7 father in writing or by the part performance of the 3 8 obligations imposed upon him. 3 9 Sec. 8. Section 613.16, subsection 1, Code 1999, is 3 10 amended to read as follows: 3 11 1. The parent or parents of an unemancipated minor child 3 12 under the age of eighteen years shall be liable for actual 3 13 damages to person or property caused by unlawful acts of such 3 14 child. However, a parent who is not entitled to legal custody 3 15 of the minor child or who does not have physical custody of 3 16 the minor child at the time of the unlawful act shall not be 3 17 liable for such damages. 3 18 Sec. 9. Section 633.425, Code 1999, is amended to read as 3 19 follows: 3 20 633.425 CLASSIFICATION OF DEBTS AND CHARGES. 3 21 In any estate in which the assets are, or appear to be, 3 22 insufficient to pay in full all debts and charges of the 3 23 estate, the personal representative shall classify the debts 3 24 and charges as follows: 3 25 1. All unpaid support payments as defined in section 3 26 598.1, and all additional unpaid awards and judgments against 3 27 the decedent in any dissolution, separate maintenance, uniform 3 28 support, or paternity action to the extent that the support, 3 29 awards, and judgments have accrued at the time of death of the 3 30 decedent. 3 311.2. Court costs. 3 322.3. Other costs of administration. 3 333.4. Reasonable funeral and burial expenses. 3 344.5. All debts and taxes having preference under the laws 3 35 of the United States. 4 15.6. Reasonable and necessary medical and hospital 4 2 expenses of the last illness of the decedent, including 4 3 compensation of persons attending at the decedent's last 4 4 illness. 4 56.7. All taxes having preferences under the laws of this 4 6 state. 4 77.8. Any debt for medical assistance paid pursuant to 4 8 section 249A.5, subsection 2. 4 98.9. All debts owing to employees for labor performed 4 10 during the ninety days next preceding the death of the 4 11 decedent. 4 129. All unpaid support payments as defined in section4 13598.1, subsection 6, and all additional unpaid awards and4 14judgments against the decedent in any dissolution, separate4 15maintenance, uniform support, or paternity action to the4 16extent that the support, awards, and judgments have accrued at4 17the time of death of the decedent.4 18 10. All other claims allowed. 4 19 EXPLANATION 4 20 The bill provides that the erection of a historical 4 21 memorial or monument for a purpose other than the 4 22 commemoration of the service rendered by a soldier, sailor, or 4 23 marine of the United States is a general county purpose for 4 24 which a county may issue a bond. Current law already provides 4 25 that a memorial or monument to commemorate the service 4 26 rendered by a soldier, sailor, or marine is a general county 4 27 purpose. 4 28 The bill also requires that a keeper of a county jail shall 4 29 provide that a male jailer be present if male prisoners are 4 30 incarcerated at the jail. Current law already provides that a 4 31 female jailer be present if female prisoners are incarcerated. 4 32 The bill eliminates the provision that the physical 4 33 condition and general reputation of applicants for city or 4 34 county assessor be considered prior to the appointment of an 4 35 assessor. The fitness of each applicant for the position 5 1 shall still be considered when selecting an assessor. 5 2 The bill also requires that minimum physical, educational, 5 3 mental, and moral requirements for the appointment of a 5 4 temporary peace officer by the director of the department of 5 5 natural resources be job-related. 5 6 The bill provides that both parents, and not just the 5 7 father, are liable for the expense of a mother's pregnancy and 5 8 confinement for a child born out of wedlock. The bill also 5 9 provides that the custodial parent may recover from the other 5 10 parent a reasonable share of the support of the child. 5 11 Current law only provides for the recovery of support by the 5 12 mother from the father. 5 13 The bill provides that a parent who does not have physical 5 14 custody of the parent's minor child at the time of the child's 5 15 unlawful act is not liable for that minor child's unlawful 5 16 act. 5 17 The bill also provides that in any estate in which the 5 18 assets are insufficient to pay all debts and charges of the 5 19 estate, paying previously unpaid support shall have first 5 20 priority for payment. Current law provides that the payment 5 21 of unpaid support shall have ninth priority, after items such 5 22 as court costs, costs of administration, burial expenses, 5 23 taxes, medical expenses from the decedent's last illness, and 5 24 certain labor performed prior to the death of the decedent. 5 25 LSB 1109DP 78 5 26 ec/cf/24
