  1  1    Section 1.  Section 411.3, subsection 3, paragraph a, Code
  1  2 1999, is amended to read as follows:
  1  3    a.  As used in this section, unless the context otherwise
  1  4 requires, "reemployed" or "reemployment" means the employment
  1  5 of a person as a police officer or fire fighter by any
  1  6 participating city after the person has commenced receiving a
  1  7 service retirement allowance from a different participating
  1  8 city under section 411.6.
  1  9    Sec. 2.  Section 411.6, subsection 1, Code 1999, is amended
  1 10 by adding the following new paragraph:
  1 11    NEW PARAGRAPH.  d.  If a person receiving a service
  1 12 retirement allowance pursuant to this section following
  1 13 service as a police officer or fire fighter with a
  1 14 participating city subsequently becomes employed as a police
  1 15 officer or fire fighter with the same city, the person shall
  1 16 no longer be eligible to receive the service retirement
  1 17 allowance.  Upon returning to employment, the person shall
  1 18 again become a member and shall contribute thereafter at the
  1 19 same rate paid prior to the service retirement, and former
  1 20 service on the basis of which the service retirement allowance
  1 21 was computed at the time of retirement shall be restored to
  1 22 full force and effect and upon subsequent retirement, the
  1 23 member shall be credited with all service as a member.  
  1 24                           EXPLANATION 
  1 25    This bill provides that a person retired as a fire fighter
  1 26 or police officer from a city and receiving a service
  1 27 retirement allowance from the municipal fire and police
  1 28 retirement system (411 system) who subsequently returns to
  1 29 employment as a police officer or fire fighter with the same
  1 30 city shall no longer be eligible to receive the retirement
  1 31 allowance.  The bill provides that upon returning to
  1 32 employment, the person will become a member of the retirement
  1 33 system, shall resume making contributions to the system, and
  1 34 shall be credited with all service as a member for purposes of
  1 35 eventually determining the person's retirement allowance.
  2  1 Under current law, a person receiving a retirement allowance
  2  2 who becomes reemployed with any city as a police officer or
  2  3 fire fighter shall continue to receive the retirement
  2  4 allowance and shall not again become a member of the
  2  5 retirement system.
