Senate Study Bill 3192 - IntroducedA Bill ForAn Act 1relating to and making appropriations for the economic
2development of the state, including to the economic
3development authority, the Iowa finance authority, the
4public employment relations board, the department of
5workforce development, and the state board of regents and
6certain regents institutions.
7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  GOALS AND ACCOUNTABILITY — ECONOMIC
2DEVELOPMENT.
   31.  For the fiscal year beginning July 1, 2024, the goals
4for the economic development authority shall be to expand and
5stimulate the state economy, increase the wealth of Iowans, and
6increase the population of the state.
   72.  To achieve the goals in subsection 1, the economic
8development authority shall do all of the following for the
9fiscal year beginning July 1, 2024:
   10a.  Concentrate its efforts on programs and activities that
11result in commercially viable products and services.
   12b.  Adopt practices and services consistent with free
13market, private sector philosophies.
   14c.  Ensure economic growth and development throughout the
15state.
   16d.  Work with businesses and communities to continually
17improve the economic development climate along with the
18economic well-being and quality of life for Iowans.
   19e.  Coordinate with other state agencies to ensure that they
20are attentive to the needs of an entrepreneurial culture.
   21f.  Establish a strong and aggressive marketing image to
22showcase Iowa’s workforce, existing industry, and potential.
23A priority shall be placed on recruiting new businesses,
24business expansion, and retaining existing Iowa businesses.
25Emphasis shall be placed on entrepreneurial development through
26helping entrepreneurs secure capital, and developing networks
27and a business climate conducive to entrepreneurs and small
28businesses.
   29g.  Encourage the development of communities and quality of
30life to foster economic growth.
   31h.  Prepare communities for future growth and development
32through development, expansion, and modernization of
33infrastructure.
   34i.  Develop public-private partnerships with Iowa businesses
35in the tourism industry, Iowa tour groups, Iowa tourism
-1-1organizations, and political subdivisions in this state to
2assist in the development of advertising efforts.
   3j.  Develop, to the fullest extent possible, cooperative
4efforts for advertising with contributions from other sources.
5   Sec. 2.  ECONOMIC DEVELOPMENT AUTHORITY.
   61.  APPROPRIATION
   7a.  There is appropriated from the general fund of the state
8to the economic development authority for the fiscal year
9beginning July 1, 2024, and ending June 30, 2025, the following
10amount, or so much thereof as is necessary, to be used for the
11purposes designated in this subsection:

   13b.  (1)  For salaries, support, miscellaneous purposes,
14programs, marketing, and the maintenance of an administration
15division, a business development division, a community
16development division, a small business development division,
17and other divisions the authority may organize.
   18(2)  For business development operations and programs,
19international trade, export assistance, workforce recruitment,
20and the partner state program.
   21(3)  For transfer to a fund created pursuant to section
2215.313 for purposes of financing strategic infrastructure
23projects.
   24(4)  For community economic development programs, tourism
25operations, community assistance, the main street program,
26the school-to-career program, the community development block
27grant, and housing programs.
   28(5)  For achieving the goals and accountability, and
29fulfilling the requirements and duties required under this Act.
   30c.  Notwithstanding section 8.33, moneys appropriated in
31this subsection that remain unencumbered or unobligated at the
32close of the fiscal year shall not revert but shall remain
33available for expenditure for the purposes designated in this
34subsection until the close of the succeeding fiscal year.
   352.  FINANCIAL ASSISTANCE RESTRICTIONS

   1a.  A business creating jobs through moneys appropriated in
2subsection 1 shall be subject to contract provisions requiring
3new and retained jobs to be filled by individuals who are
4citizens of the United States who reside within the United
5States, or any person authorized to work in the United States
6pursuant to federal law, including legal resident aliens
7residing in the United States.
   8b.  Any vendor who receives moneys appropriated in
9subsection 1 shall adhere to such contract provisions and
10provide periodic assurances as the state shall require that the
11jobs are filled solely by citizens of the United States who
12reside within the United States, or any person authorized to
13work in the United States, pursuant to federal law, including
14legal resident aliens residing in the United States.
   15c.  A business that receives financial assistance from
16the authority from moneys appropriated in subsection 1 shall
17only employ individuals legally authorized to work in this
18state. In addition to all other applicable penalties provided
19by current law, all or a portion of the assistance received
20by a business which is found to knowingly employ individuals
21not legally authorized to work in this state is subject to
22recapture by the authority.
   233.  USES OF APPROPRIATIONS
   24a.  From the moneys appropriated in subsection 1, the
25authority may provide financial assistance in the form of a
26grant to a community economic development entity for conducting
27a local workforce recruitment effort designed to recruit former
28citizens of the state and former students at colleges and
29universities in the state to meet the needs of local employers.
   30b.  From the moneys appropriated in subsection 1, the
31authority may provide financial assistance to early stage
32industry companies being established by women entrepreneurs.
   33c.  From the moneys appropriated in subsection 1, the
34authority may provide financial assistance in the form of
35grants, loans, or forgivable loans for advanced research and
-3-1commercialization projects involving value-added agriculture,
2advanced technology, or biotechnology.
   34.WORLD FOOD PRIZE
4In lieu of the standing appropriation in section 15.368,
5there is appropriated from the general fund of the state to the
6economic development authority for the fiscal year beginning
7July 1, 2024, and ending June 30, 2025, the following amount
8for the world food prize:

   105.  COUNCILS OF GOVERNMENTS — ASSISTANCE
   11There is appropriated from the general fund of the state
12to the economic development authority for the fiscal year
13beginning July 1, 2024, and ending June 30, 2025, the following
14amount to be used for the purposes of providing financial
15assistance to Iowa’s councils of governments:

   176.  TOURISM OFFICE
   18a.  There is appropriated from the general fund of the state
19to the economic development authority for the fiscal year
20beginning July 1, 2024, and ending June 30, 2025, the following
21amount for the tourism office to be used for advertising,
22promoting, placement, and implementation of the economic
23development authority’s strategic plan for tourism and travel:

   25b.  Notwithstanding section 8.33, moneys appropriated in
26this subsection that remain unencumbered or unobligated at the
27close of the fiscal year shall not revert but shall remain
28available for expenditure for the purposes designated until the
29close of the succeeding fiscal year.
   30c.  The economic development authority shall submit an
31annual report on or before January 15 to the general assembly
32regarding the tourism office’s activities funded with moneys
33appropriated under this subsection. The report shall be
34provided in an electronic format and shall include metrics
35and criteria that allow the general assembly to quantify
-4-1and evaluate the effectiveness and economic impact of the
2tourism office’s activities related to advertising, promoting,
3placement, and implementation of the economic development
4authority’s strategic plan for tourism and travel.
   57.  CULTURAL AFFAIRS ACTIVITIES
   6a.  There is appropriated from the general fund of the state
7to the economic development authority for the fiscal year
8beginning July 1, 2024, and ending June 30, 2025, the following
9amounts, or so much thereof as is necessary, to be used for the
10purposes designated:
   11(1)  For planning and programming for the community cultural
12grants program established under section 15.436:

   14(2)  For support of the Iowa arts council:

   16Of the moneys appropriated in this subparagraph, the
17authority shall allocate $300,000 for purposes of the film
18office.
   19(3)  For the Iowa great places program established under
20section 15.439:

   22(4)  For grant programs administered by the Iowa arts
23council including those programs supporting the long-term
24financial stability and sustainability of nonprofit cultural
25organizations:

   27b.  Notwithstanding section 8.33, moneys appropriated in
28this subsection that remain unencumbered or unobligated at the
29close of the fiscal year shall not revert but shall remain
30available for expenditure for the purposes designated until the
31close of the succeeding fiscal year.
32   Sec. 3.  LIMITATIONS OF STANDING APPROPRIATIONS — FY
332024-2025.
  Notwithstanding the standing appropriations
34in the following designated sections for the fiscal year
35beginning July 1, 2024, and ending June 30, 2025, the amounts
-5-1appropriated from the general fund of the state pursuant to
2those sections for the following purposes shall not exceed the
3following amounts:
   41.  For operational support grants and community cultural
5grants under section 99F.11, subsection 4, paragraph “d”,
6subparagraph (1):

   82.  For the purposes of regional tourism marketing under
9section 99F.11, subsection 4, paragraph “d”, subparagraph (2):

11   Sec. 4.  FINANCIAL ASSISTANCE REPORTING — ECONOMIC
12DEVELOPMENT AUTHORITY.
  The economic development authority
13shall submit an annual report to the general assembly no later
14than November 1, 2024, that details the amount of every direct
15loan, forgivable loan, tax credit, tax exemption, tax refund,
16grant, or any other financial assistance awarded to a person
17during the prior fiscal year by the authority under an economic
18development program administered by the authority. The report
19shall identify the county where the project associated with
20each such award is located.
21   Sec. 5.  INSURANCE ECONOMIC DEVELOPMENT.  From the moneys
22collected by the insurance division of the department of
23insurance and financial services in excess of the anticipated
24gross revenues under section 505.7, subsection 3, during
25the fiscal year beginning July 1, 2024, $100,000 shall be
26transferred to the economic development authority for insurance
27economic development and international insurance economic
28development.
29   Sec. 6.  IOWA FINANCE AUTHORITY.
   301.  There is appropriated from the general fund of the state
31to the Iowa finance authority for the fiscal year beginning
32July 1, 2024, and ending June 30, 2025, the following amounts,
33or so much thereof as is necessary, to be used for the purposes
34designated:
   35a.  Rent subsidy program

   1(1)  To provide reimbursement for rent expenses to eligible
2persons under the home and community-based services rent
3subsidy program established in section 16.55:

   5(2)  Of the moneys appropriated in this paragraph, not more
6than $35,000 may be used for administrative costs.
   7b.  Housing renewal pilot program
   8To provide housing renewal moneys to a nonprofit Iowa
9affiliate to award grants to eligible communities for a housing
10renewal pilot program:

   122.  Notwithstanding section 8.33, moneys appropriated in
13this section that remain unencumbered or unobligated at the
14close of the fiscal year shall not revert but shall remain
15available for expenditure for the purposes designated until the
16close of the succeeding fiscal year.
17   Sec. 7.  IOWA FINANCE AUTHORITY AUDIT.  The auditor of state
18is requested to review the audit of the Iowa finance authority
19performed by the auditor hired by the authority.
20   Sec. 8.  PUBLIC EMPLOYMENT RELATIONS BOARD.
   211.  There is appropriated from the general fund of the state
22to the public employment relations board for the fiscal year
23beginning July 1, 2024, and ending June 30, 2025, the following
24amount, or so much thereof as is necessary, to be used for the
25purposes designated:
   26For salaries, support, maintenance, and miscellaneous
27purposes:

   292.  Of the moneys appropriated in this section, the board
30shall allocate $15,000 for maintaining an internet site that
31allows access to a searchable database of collective bargaining
32information.
33   Sec. 9.  DEPARTMENT OF WORKFORCE DEVELOPMENT.  There
34is appropriated from the general fund of the state to the
35department of workforce development for the fiscal year
-7-1beginning July 1, 2024, and ending June 30, 2025, the following
2amounts, or so much thereof as is necessary, to be used for the
3purposes designated:
   41.  WORKFORCE DEVELOPMENT OPERATIONS
   5a.  For the operation of field offices and the workforce
6development board:

   8b.  Of the moneys appropriated in paragraph “a”, the
9department shall allocate $150,000 to the state library for the
10purpose of licensing an online resource which prepares persons
11to succeed in the workplace through programs which improve job
12skills and vocational test-taking abilities.
   132.  OFFENDER REENTRY PROGRAM
   14a.  For the development and administration of an offender
15reentry program to provide offenders with employment skills:

   213.  INTEGRATED INFORMATION FOR IOWA SYSTEM

23administrative services related to the integrated information
24for Iowa system:

   264.  WORKPLACE INJURY AND SAFETY SURVEYS
   27For the operation of workplace safety surveys and workplace
28data collection and analysis, including salaries, support,
29maintenance, and miscellaneous purposes:

   315.  SUMMER YOUTH INTERN PILOT PROGRAM
   32For the funding of a summer youth intern pilot program that
33will help young people at risk of not graduating from high
34school to explore and prepare for high-demand careers through
35summer work experience, including the development of soft

   36.  DIVISION OF VOCATIONAL REHABILITATION SERVICES
   4a.  For salaries, support, maintenance, and miscellaneous

   7For purposes of optimizing the job placement of individuals
8with disabilities, the division shall make its best efforts
9to work with community rehabilitation program providers for
10job placement and retention services for individuals with
11significant disabilities and most significant disabilities. By
12January 15, 2025, the division shall submit a written report to
13the general assembly regarding the division’s outreach efforts
14with community rehabilitation program providers.
   15b.  For matching moneys for programs to enable persons
16with severe physical or mental disabilities to function more
17independently, including salaries and support:

   30In issuing grants under this subsection, the department of
31workforce development shall use the same application process
32and criteria as are used for purposes of awarding grants to
33community colleges for the purpose of adult basic education
34programs for students requiring instruction in English as a
35second language using moneys that are appropriated to the

   28.  REGISTERED APPRENTICESHIP DEVELOPMENT PROGRAMS
   3For the funding of registered apprenticeship development
4programs in the department of workforce development:

12PROGRAM.
  There is appropriated from the general fund of the
13state to the department of workforce development for the fiscal
14year beginning July 1, 2024, and ending June 30, 2025, the
15following amount, or so much thereof as is necessary, to be
16used for the purposes designated:
   17For enhancing efforts to investigate employers that
18misclassify workers:

20   Sec. 11.  SPECIAL EMPLOYMENT SECURITY CONTINGENCY FUND.
   211.  There is appropriated from the special employment
22security contingency fund created in section 96.13 to the
23department of workforce development for the fiscal year
24beginning July 1, 2024, and ending June 30, 2025, the following
25amount, or so much thereof as is necessary, to be used for
26field offices:

   282.  Any remaining additional penalty and interest revenue
29collected by the department of workforce development is
30appropriated to the department for the fiscal year beginning

32mission of the department.
33   Sec. 12.  UNEMPLOYMENT COMPENSATION RESERVE FUND — FIELD
34OFFICES.
  Notwithstanding section 96.9, subsection 8, paragraph
35“e”, there is appropriated from interest earned on the
-10-1unemployment compensation reserve fund created in section 96.9
2to the department of workforce development for the fiscal year
3beginning July 1, 2024, and ending June 30, 2025, the following
4amount, or so much thereof as is necessary, to be used for the
5purposes designated:

8   Sec. 13.  IOWA SKILLED WORKER AND JOB CREATION FUND.
   91.  There is appropriated from the Iowa skilled worker and
10job creation fund created in section 8.75 to the following
11departments, agencies, and institutions for the fiscal year
12beginning July 1, 2024, and ending June 30, 2025, the following
13amounts, or so much thereof as is necessary, to be used for the
14purposes designated:
   15a.  ECONOMIC DEVELOPMENT AUTHORITY
   16(1)  For the purposes of providing assistance as described in
17section 15.335B for the high quality jobs program:

   19(a)  From the moneys appropriated in this subparagraph
20(1), the economic development authority may use not more than
21$1,000,000 for purposes of providing infrastructure grants to
22main street communities under the main street Iowa program.
   23(b)  As a condition of receiving moneys appropriated in this
24subparagraph (1), an entity shall testify upon the request of
25the joint appropriations subcommittee on economic development
26regarding the expenditure of such moneys.
   27(2)  For support of the manufacturing 4.0 technology
28investment program established in section 15.371:

   32b.  STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
   33(1)  STATE BOARD OF REGENTS. For capacity building
34infrastructure in areas related to technology
35commercialization, marketing and business development

2entrepreneurship, and business growth, and infrastructure
3projects and programs needed to assist in implementation of
4activities under chapter 262B:

   6(a)  Of the moneys appropriated pursuant to this
7subparagraph (1), 35 percent shall be allocated for Iowa state
8university of science and technology, 35 percent shall be
9allocated for the state university of Iowa, and 30 percent
10shall be allocated for the university of northern Iowa.
   11(b)  The institutions shall provide a one-to-one match
12of additional moneys for the activities funded with moneys
13appropriated under this subparagraph (1).
   14(c)  The state board of regents shall submit a report by
15January 15, 2025, to the governor and the general assembly
16regarding the activities, projects, and programs funded with
17moneys appropriated under this subparagraph (1). The report
18shall be provided in an electronic format and shall include a
19list of metrics and criteria mutually agreed to in advance by
20the board of regents and the economic development authority.
21The metrics and criteria shall allow the governor’s office and
22the general assembly to quantify and evaluate the progress
23of the board of regents institutions with regard to their
24activities, projects, and programs in the areas of technology
25commercialization, entrepreneurship, regional development, and
26market research.
   27(2)  IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
28small business development centers, the research park, and the
29center for industrial research and service:

   31(a)  Of the moneys appropriated in this subparagraph (2),
32Iowa state university of science and technology shall allocate
33at least $735,728 for purposes of funding small business
34development centers. Iowa state university of science and
35technology may allocate the appropriated moneys to the various
-12-1small business development centers in any manner necessary to
2achieve the purposes of this subparagraph.
   3(b)  Iowa state university of science and technology shall
4do all of the following:
   5(i)  Direct expenditures for research toward projects that
6will provide economic stimulus for Iowa.
   7(ii)  Provide emphasis to providing services to Iowa-based
8companies.
   9(c)  It is the intent of the general assembly that the
10industrial incentive program focus on Iowa industrial sectors
11and seek contributions and in-kind donations from businesses,
12industrial foundations, and trade associations, and that moneys
13for the center for industrial research and service industrial
14incentive program shall be allocated only for projects which
15are matched by private sector moneys for directed contract
16research or for nondirected research. The match required of
17small businesses as defined in section 15.102 for directed
18contract research or for nondirected research shall be $1
19for each $3 of state funds. The match required for other
20businesses for directed contract research or for nondirected
21research shall be $1 for each $1 of state funds. The match
22required of industrial foundations or trade associations shall
23be $1 for each $1 of state funds.
   24(d)  Iowa state university of science and technology shall
25report annually to the general assembly the total amount of
26private contributions, the proportion of contributions from
27small businesses and other businesses, and the proportion for
28directed contract research and nondirected research of benefit
29to Iowa businesses and industrial sectors.
   30(3)  STATE UNIVERSITY OF IOWA
   31(a)  For the state university of Iowa research park and for
32university of Iowa pharmaceuticals located at the research
33park, including salaries, support, maintenance, equipment, and
34miscellaneous purposes:

   1The state university of Iowa shall do all of the following:
   2(i)  Direct expenditures for research toward projects that
3will provide economic stimulus for Iowa.
   4(ii)  Provide emphasis to providing services to Iowa-based
5companies.
   6(b)  For the purpose of implementing the entrepreneurship
7and economic growth initiative:

   9(4)  UNIVERSITY OF NORTHERN IOWA. For the metal casting and
10foundry 4.0 centers, advance Iowa, family business center, and
11the institute for decision making, including salaries, support,
12maintenance, and miscellaneous purposes:

   14The university of northern Iowa shall do all of the
15following:
   16(a)  Direct expenditures for research toward projects that
17will provide economic stimulus for Iowa.
   18(b)  Provide emphasis to providing services to Iowa-based
19companies.
   20(5)  As a condition of receiving moneys appropriated in
21this lettered paragraph “b”, an entity shall testify upon the
22request of the joint appropriations subcommittee on economic
23development regarding the expenditure of such moneys.
   24c.  DEPARTMENT OF WORKFORCE DEVELOPMENT
   25(1)  To develop a long-term sustained program to train
26unemployed and underemployed central Iowans with skills
27necessary to advance to higher-paying jobs with full benefits:

   29As a condition of receiving moneys appropriated under this
30subparagraph (1), an entity shall testify upon the request of
31the joint appropriations subcommittee on economic development
32regarding the expenditure of such moneys.
   33(2)  For distribution to community colleges for the purposes
34of implementing adult education and literacy programs pursuant
35to section 84A.19:

   2(a)  From the moneys appropriated in this numbered
3subparagraph, $3,883,000 shall be allocated pursuant to the
4formula established in section 260C.18C.
   5(b)  From the moneys appropriated in this numbered
6subparagraph, not more than $150,000 shall be used by the
7department of workforce development for implementation of adult
8education and literacy programs pursuant to section 84A.19.
   9(c)  From the moneys appropriated in this numbered
10subparagraph, not more than $1,257,000 shall be distributed
11as grants to community colleges for the purpose of adult
12basic education programs for students requiring instruction
13in English as a second language. The department of workforce
14development shall establish an application process and criteria
15to award grants pursuant to this subparagraph division to
16community colleges. The criteria shall be based on need for
17instruction in English as a second language in the region
18served by each community college as determined by factors
19including data from the latest federal decennial census and
20outreach efforts to determine regional needs.
   21(d)  From the moneys appropriated in this numbered
22subparagraph, $210,000 shall be transferred to the department
23of health and human services for purposes of administering a
24program to provide access to international resources to Iowans
25and new Iowans to provide economic and leadership development
26resulting in Iowa being a more inclusive and welcoming place
27to live, work, and raise a family. The program shall provide
28supplemental support services for international refugees to
29improve learning, English literacy, life skills, cultural
30competencies, and integration in a county with a population
31over 350,000 as determined by the 2020 federal decennial
32census. The department of health and human services shall
33utilize a request for proposals process to identify the entity
34best qualified to implement the program.
   35(3)  For the funding of internships for students studying in
-15-1the fields of science, technology, engineering, and mathematics
2with eligible Iowa employers as provided in section 15.411,
3subsection 3, paragraph “c”:

   52.  Notwithstanding section 8.33, moneys appropriated in
6this section that remain unencumbered or unobligated at the
7close of the fiscal year shall not revert but shall remain
8available for expenditure for the purposes designated until the
9close of the succeeding fiscal year.
10   Sec. 14.  GENERAL FUND — CERTAIN REGENTS INSTITUTIONS.
   111.  There is appropriated from the general fund of the state
12to the following institutions for the fiscal year beginning
13July 1, 2024, and ending June 30, 2025, the following amounts,
14or so much thereof as is necessary, to be used for the purposes
15designated:
   16a.  IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY
   17In cooperation with the economic development authority, for
18support of a biosciences innovation ecosystem, to strengthen
19Iowa’s leadership positions in the area of bio-based chemicals,
20digital agriculture, vaccines, and medical devices, including

   1The university of northern Iowa shall make a good-faith
2effort to coordinate with private entities to seek moneys to
3supplement this appropriation to support the expansion of the
4university’s additive manufacturing capabilities.
   52.  Notwithstanding section 8.33, moneys appropriated in
6subsection 1, paragraphs “a” and “b”, that remain unencumbered
7or unobligated at the close of the fiscal year shall not revert
8but shall remain available for expenditure for the purposes
9designated until the close of the succeeding fiscal year.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill relates to and makes appropriations for the
14economic development of the state.
   15The bill appropriates moneys for FY 2024-2025 from
16the general fund of the state to the economic development
17authority, the Iowa finance authority, the public employment
18relations board, the department of workforce development,
19Iowa state university of science and technology, the state
20university of Iowa, and the university of northern Iowa.
   21The bill appropriates moneys for FY 2024-2025 from the
22Iowa skilled worker and job creation fund to the economic
23development authority, the department of workforce development,
24and the state board of regents and institutions under the
25control of the board.
   26For FY 2024-2025, the bill limits standing appropriations
27for the world food prize, certain operational support grants,
28community cultural grants, and regional tourism marketing.
   29The bill transfers $100,000 of the moneys collected by the
30insurance division in excess of the anticipated gross revenues
31under Code section 505.7 to the economic development authority.
   32The bill appropriates moneys for FY 2024-2025 from the
33special employment security contingency fund and interest
34earned on the unemployment compensation reserve fund to the
35department of workforce development.

   1The auditor of state is requested to review the audit of the
2Iowa finance authority performed by the auditor hired by the
3authority.
   4The bill requires the economic development authority,
5the division of vocational rehabilitation services of the
6department of workforce development, the state board of
7regents, and Iowa state university of science and technology to
8submit various reports to the general assembly.
