4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. NEW SECTION. 562B.33 Enforcement.
2The attorney general shall have the authority to investigate
3and enforce repeated or multiple violations of this chapter.
4Repeated or multiple violations of this chapter are an
5unlawful practice under section 714.16 and all the remedies and
6penalties of section 714.16 are available for such a violation.
7EXPLANATION
8The inclusion of this explanation does not constitute agreement with
9the explanation’s substance by the members of the general assembly.
10This bill authorizes the attorney general to investigate and
11enforce repeated or multiple violations of Code chapter 562B.
12 The bill also provides that repeated or multiple violations
13of Code chapter 562B are an unlawful practice under Code
14section 714.16 (consumer frauds). Several types of remedies
15are available if a court finds that a person has committed an
16unlawful practice, including injunctive relief, disgorgement of
17moneys or property, and a civil penalty not to exceed $40,000
18per violation.
