10provisions.
11BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2SHORT TITLE
3   Section 1.  SHORT TITLE.  This Act shall be known and may be
4cited as the “Combating Terrorist Sympathizers Act”.
5DIVISION II
6DECERTIFICATION OF STUDENT ORGANIZATIONS — STUDENT
7INELIGIBILITY FOR FINANCIAL AID — PUBLIC INSTITUTIONS OF
8HIGHER EDUCATION
9   Sec. 2.  NEW SECTION.  261J.1  Definitions.
   10As used in this chapter:
   111.  “Public institution of higher education” means a community
12college established under chapter 260C or an institution of
13higher learning governed by the state board of regents.
   142.  “Student organization” means a group officially
15recognized at or officially registered by a public institution
16of higher education, or a group seeking such official
17recognition or official registration, comprised of students who
18are admitted and in attendance at the public institution of
19higher education.
20   Sec. 3.  NEW SECTION.  261J.2  Cancellation of student
21organization recognition or registration.
   221.  The attorney general shall provide notice to a public
23institution of higher education and to the state board of
24regents or the board of directors of a community college, as
25applicable, within fifteen days after a student organization
26registered or recognized by the public institution of higher
27education endorses or promotes any of the following:
   28a.  Terrorism.
   29b.  The actions of any organization that is designated by
30the United States secretary of state as a foreign terrorist
31organization.
   322.  Notwithstanding chapter 261H, a public institution of
33higher education shall cancel the recognition or registration
34of a student organization that endorses or promotes any of the
35following within thirty days after the endorsement or promotion

   2a.  Terrorism.
   3b.  The actions of any organization that is designated by
4the United States secretary of state as a foreign terrorist
5organization.
   63.  If a public institution of higher education fails to
7comply with subsection 2, the attorney general shall bring an
8action against the public institution of higher education for
9a writ of mandamus to compel the public institution of higher
10education to comply with subsection 2.
11   Sec. 4.  NEW SECTION.  261J.3  Students who endorse or
12promote terrorism or terrorist organizations ineligible for state
13financial aid.
   141.  The attorney general shall provide notice to a public
15institution of higher education, the department of education,
16and to the state board of regents or the board of directors of
17a community college, as applicable, within fifteen days after a
18student who attends the public institution of higher education
19endorses or promotes any of the following:
   20a.  Terrorism.
   21b.  The actions of any organization that is designated by
22the United States secretary of state as a foreign terrorist
23organization.
   242.  A student shall not be eligible to receive any financial
25aid provided by the public institution of higher education, or
26any state financial aid, including any financial aid provided
27under chapter 256, subchapter VII, part 4, in the succeeding
28fiscal year, or in any subsequent fiscal years, if the attorney
29general determines that the student has endorsed or promoted
30any of the following:
   31a.  Terrorism.
   32b.  The actions of any organization that is designated by
33the United States secretary of state as a foreign terrorist
34organization.
   353.  If a student is ineligible to receive financial aid
-2-1pursuant to subsection 2, the department of education shall
2provide notice to the student of the student’s ineligibility.
3DIVISION III
4STUDENTS ENROLLED IN PRIVATE INSTITUTIONS OF HIGHER EDUCATION
5— INELIGIBILITY UNDER IOWA TUITION GRANTS PROGRAM
6   Sec. 5.  Section 256.184, Code 2024, is amended to read as
7follows:
   8256.184  Who qualified.
   9A Subject to section 256.191A, a tuition grant may be awarded
10to a resident of Iowa who is admitted and in attendance as
11a full-time or part-time resident student at an accredited
12private institution and who establishes financial need.
13   Sec. 6.  Section 256.191, subsection 1, Code 2024, is amended
14to read as follows:
   151.  Students qualified.  A Subject to section 256.191A,

tuition grant from moneys appropriated under section
17256.194, subsection 2, may be awarded to a resident of Iowa
18who is admitted and in attendance as a full-time or part-time
19resident student at an eligible institution and who establishes
20financial need.
21   Sec. 7.  NEW SECTION.  256.191A  Students who endorse or
22promote terrorism or terrorist organizations ineligible.
   231.  The attorney general shall provide notice to the
24department of education and an accredited private institution
25or an eligible institution within fifteen days after a student
26who attends the accredited private institution or eligible
27institution endorses or promotes any of the following:
   28a.  Terrorism.
   29b.  The actions of any organization that is designated by
30the United States secretary of state as a foreign terrorist
31organization.
   322.  Notwithstanding any other provision of this subpart to
33the contrary, a student shall not be eligible to receive grants
34under this subpart in the succeeding fiscal year, or in any
35subsequent fiscal years, if the attorney general determines
-3-1that the student has endorsed or promoted any of the following:
   2a.  Terrorism.
   3b.  The actions of any organization that is designated by
4the United States secretary of state as a foreign terrorist
5organization.
   63.  If a student is ineligible to receive grants under
7this subpart pursuant to subsection 2, the department of
8education shall provide notice to the student of the student’s
9ineligibility.
10DIVISION IV
11EFFECTIVE DATE
12   Sec. 8.  EFFECTIVE DATE.  This Act, being deemed of immediate
13importance, takes effect upon enactment.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill relates to higher education, including requiring
18the cancellation of the recognition or registration of public
19institution of higher education student organizations that
20support or endorse terrorism or certain specified terrorist
21organizations, prohibiting students enrolled in institutions of
22higher education who support or endorse terrorism or certain
23specified terrorist organizations from receiving certain
24specified forms of financial aid, and modifying the duties of
25the attorney general.
   26DIVISION I — SHORT TITLE. The bill shall be known and may
27be cited as the “Combating Terrorist Sympathizers Act”.
   28DIVISION II — DECERTIFICATION OF STUDENT ORGANIZATIONS —
29PUBLIC INSTITUTIONS OF HIGHER EDUCATION. The division requires
30the attorney general to provide notice to a public institution
31of higher education and to the state board of regents or the
32board of directors of a community college, as applicable,
33within 15 days after a student organization endorses or
34promotes terrorism or the actions of any foreign terrorist
35organization.

   1The division requires a public institution of higher
2education to cancel the recognition or registration of a
3student organization that endorses or promotes violence,
4terrorism, or the actions of any foreign terrorist organization
5within 30 days after the endorsement or promotion occurs.
6The division provides that if a public institution of higher
7education fails to comply with this provision, the attorney
8general shall bring an action against the public institution of
9higher education for a writ of mandamus to compel the public
10institution of higher education to comply.
   11The division requires the attorney general to provide notice
12to a public institution of higher education, the department of
13education, and to the state board of regents or the board of
14directors of a community college, as applicable, within 15 days
15after a student endorses or promotes terrorism or the actions
16of any foreign terrorist organization. The division provides
17that a student shall not be eligible to receive any financial
18aid provided by the public institution of higher education, or
19any state financial aid, in the succeeding fiscal year, or in

21that the student has endorsed or promoted terrorism or the
22actions of any foreign terrorist organization. The division

   25The division defines “public institution of higher
26education” as a community college or an institution of higher
27learning governed by the state board of regents. The division
28defines “student organization” as a group officially recognized
29at or officially registered by a public institution of higher
30education, or a group seeking such official recognition
31or official registration, comprised of students who are
32admitted and in attendance at the public institution of higher
33education.
