3   Section 1.  DEPARTMENT OF ADMINISTRATIVE SERVICES.
   41.  There is appropriated from the general fund of the state
5to the department of administrative services for the fiscal
6year beginning July 1, 2023, and ending June 30, 2024, the
7following amounts, or so much thereof as is necessary, to be
8used for the purposes designated:

14appropriated under this paragraph and paragraphs “f” and “g”.

   202.  Any moneys and premiums collected by the department
21for workers’ compensation shall be segregated into a separate
22workers’ compensation fund in the state treasury to be used
23for payment of state employees’ workers’ compensation claims
24and administrative costs. Notwithstanding section 8.33,
25unencumbered or unobligated moneys remaining in this workers’
26compensation fund at the end of the fiscal year shall not
27revert but shall remain available for expenditure for purposes
28of the fund in subsequent fiscal years.
29   Sec. 2.  REVOLVING FUNDS.  There is appropriated to the
30department of administrative services for the fiscal year
31beginning July 1, 2023, and ending June 30, 2024, from the
32revolving funds designated in chapter 8A and from internal
33service funds created by the department such amounts as the
34department deems necessary for the operation of the department
35consistent with the requirements of chapter 8A.

1   Sec. 3.  STATE EMPLOYEE HEALTH INSURANCE ADMINISTRATION
2CHARGE.
  For the fiscal year beginning July 1, 2023, and ending
3June 30, 2024, the monthly per contract administrative charge
4which may be assessed by the department of administrative
5services shall be $2.00 per contract on all health insurance
6plans administered by the department.
7   Sec. 4.  AUDITOR OF STATE.
   81.  There is appropriated from the general fund of the state
9to the office of the auditor of state for the fiscal year
10beginning July 1, 2023, and ending June 30, 2024, the following
11amount, or so much thereof as is necessary, to be used for the
12purposes designated:

   182.  The auditor of state may retain additional full-time
19equivalent positions as is reasonable and necessary to
20perform governmental subdivision audits which are reimbursable

23to perform work requested by and reimbursable from departments
24or agencies pursuant to section 11.5A or 11.5B. The auditor
25of state shall notify the department of management, the
26legislative fiscal committee, and the legislative services
27agency of the additional full-time equivalent positions
28retained.
   293.  The auditor of state shall allocate moneys from the
30appropriation in this section solely for audit work related to
31the annual comprehensive financial report, federally required
32audits, and investigations of embezzlement, theft, or other
33significant financial irregularities until the audit of the
34annual comprehensive financial report is complete.
35   Sec. 5.  IOWA ETHICS AND CAMPAIGN DISCLOSURE BOARD.   There

23summary of the number of cases investigated, case outcomes,
24overpayment dollars identified, amount of cost avoidance, and
25actual dollars recovered.
   264.  HEALTH FACILITIES
   27a.  For salaries, support, maintenance, and miscellaneous
28purposes, and for not more than the following full-time
29equivalent positions:

   32b.  The department shall make all of the following
33information available to the public as part of the department’s
34development efforts to revise the department’s internet site:
   35(1)  The number of inspections of health facilities

2provider and type of inspection.
   3(2)  The total annual operations budget for the department
4that is associated with health facilities regulation, including
5general fund appropriations and federal contract dollars
6received by type of service provider inspected.
   7(3)  The total number of full-time equivalent positions
8in the department that are associated with health facilities
9regulation, to include the number of full-time equivalent
10positions serving in a supervisory capacity, and serving as
11surveyors, inspectors, or monitors in the field by type of
12service provider inspected.
   13(4)  Identification of state and federal survey trends,
14cited regulations, the scope and severity of deficiencies
15identified, and federal and state fines assessed and collected
16concerning nursing and assisted living facilities and programs.
   17c.  It is the intent of the general assembly that the
18department continuously solicit input from health facilities
19regulated by the department to assess and improve the
20department’s level of collaboration and to identify new
21opportunities for cooperation.
   225.  EMPLOYMENT APPEAL BOARD
   23a.  For salaries, support, maintenance, and miscellaneous
24purposes, and for not more than the following full-time
25equivalent positions:

   28b.  The employment appeal board shall be reimbursed by the
29department for all costs associated with hearings conducted
30under chapter 91C, related to contractor registration. The
31board may expend, in addition to the amount appropriated under
32this subsection, additional amounts as are directly billable
33to the department under this subsection and to retain the
34additional full-time equivalent positions as needed to conduct
35hearings required pursuant to chapter 91C.

   1c.  The employment appeal board may temporarily exceed and
2draw more than the amount appropriated in this subsection and
3incur a negative cash balance as long as there are receivables
4of federal funds equal to or greater than the negative balance
5and the amount appropriated in this subsection is not exceeded
6at the close of the fiscal year.
   76.  FOOD AND CONSUMER SAFETY

   19b.  The Iowa state civil rights commission may enter into
20a contract with a nonprofit organization to provide legal

   289.  DIVISION OF WORKERS’ COMPENSATION

   34b.  The division of workers’ compensation shall charge a
35$100 filing fee for workers’ compensation cases. The filing
-7-1fee shall be paid by the petitioner of a claim. However,
2the fee can be taxed as a cost and paid by the losing party,
3except in cases where it would impose an undue hardship or be
4unjust under the circumstances. The moneys generated by the
5filing fee allowed under this paragraph are appropriated to
6the department to be used for purposes of administering the
7division of workers’ compensation.
   810.  PROFESSIONAL LICENSING
   9For salaries, support, maintenance, and miscellaneous
10purposes, and for not more than the following full-time
11equivalent positions:

   1411.  APPROPRIATION REALLOCATION.  Notwithstanding section
158.39, the department of inspections, appeals, and licensing,
16in consultation with the department of management, may
17reallocate moneys appropriated in this section as necessary to
18best fulfill the needs of the department provided for in the
19appropriation.
20   Sec. 8.  DEPARTMENT OF INSPECTIONS, APPEALS, AND LICENSING
21— LICENSE OR REGISTRATION FEES.
   221.  For the fiscal year beginning July 1, 2023, and ending
23June 30, 2024, the department of inspections, appeals, and
24licensing shall collect any license or registration fees or
25electronic transaction fees generated during the fiscal year
26as a result of licensing and registration activities under
27chapters 99B, 137C, 137D, and 137F.
   282.  From the fees collected by the department under this
29section on behalf of a municipal corporation with which
30the department has an agreement pursuant to section 137F.3,
31through a statewide electronic licensing system operated by
32the department, notwithstanding section 137F.6, subsection 2,
33the department shall remit the amount of those fees to the
34municipal corporation for whom the fees were collected less
35any electronic transaction fees collected by the department to
-8-1enable electronic payment.
   23.  From the fees collected by the department under this
3section, other than those fees described in subsection 2, the
4department shall deposit the amount of $________ into the
5general fund of the state prior to June 30, 2024.
   64.  From the fees collected by the department under this
7section, other than those fees described in subsections 2 and
83, the department shall retain the remainder of the fees for
9the purposes of enforcing the provisions of chapters 99B, 137C,
10137D, and 137F. Notwithstanding section 8.33, moneys retained
11by the department pursuant to this subsection that remain
12unencumbered or unobligated at the close of the fiscal year
13shall not revert but shall remain available for expenditure
14for the purposes of enforcing the provisions of chapters 99B,
15137C, 137D, and 137F during the succeeding fiscal year. The
16department shall provide an annual report to the department
17of management and the legislative services agency on fees
18billed and collected and expenditures from the moneys retained
19by the department in a format determined by the department
20of management in consultation with the legislative services
21agency.
22   Sec. 9.  HOUSING TRUST FUND APPROPRIATION — DEPARTMENT OF
23INSPECTIONS, APPEALS, AND LICENSING.
  There is appropriated
24from the housing trust fund created in section 16.181 to the
25department of inspections, appeals, and licensing for the
26fiscal year beginning July 1, 2023, and ending June 30, 2024,
27the following amount, or so much thereof as is necessary, to be
28used for the purposes designated:

30purposes may exceed the projected receipts, refunds, and
31reimbursements, estimated pursuant to section 505.7, subsection
327, including the expenditures for retention of additional
33personnel, if the expenditures are fully reimbursable and the
34division first does all of the following:
   35(1)  Notifies the department of management, the legislative

2need for the expenditures.
   3(2)  Files with each of the entities named in subparagraph
4(1) the legislative and regulatory justification for the

28fiscal year beginning July 1, 2023, and ending June 30, 2024,
29from the revolving funds designated in chapter 8B and from
30internal service funds created by the office such amounts as
31the office deems necessary for the operation of the office
32consistent with the requirements of chapter 8B.
   332.  a.  Notwithstanding section 321A.3, subsection 1, for
34the fiscal year beginning July 1, 2023, and ending June 30,
352024, the first $___________ collected and transferred to the
-12-1treasurer of state with respect to the fees for transactions
2involving the furnishing of a certified abstract of a vehicle
3operating record under section 321A.3, subsection 1, shall
4be transferred to the IowAccess revolving fund created in
5section 8B.33 for the purposes of developing, implementing,
6maintaining, and expanding electronic access to government
7records as provided by law.
   8b.  All fees collected with respect to transactions
9involving IowAccess shall be deposited in the IowAccess
10revolving fund created under section 8B.33 and shall be used
11only for the support of IowAccess projects.
12   Sec. 15.  ROAD USE TAX FUND APPROPRIATION — DEPARTMENT OF
13MANAGEMENT.
  There is appropriated from the road use tax fund
14created in section 312.1 to the department of management for
15the fiscal year beginning July 1, 2023, and ending June 30,

6   Sec. 22.  SECRETARY OF STATE FILING FEES REFUND.
  7Notwithstanding the obligation to collect fees pursuant to the
8provisions of section 489.117, subsection 1, paragraphs “c” and
9“q”, section 490.122, subsection 1, paragraph “a”, and section
10504.113, subsection 1, paragraphs “a”, “c”, “d”, “j”, “k”,
11“l”, and “m”, for the fiscal year beginning July 1, 2023, the
12secretary of state may refund these fees to the filer pursuant
13to rules established by the secretary of state. The decision
14of the secretary of state not to issue a refund under rules
15established by the secretary of state is final and not subject
16to review pursuant to chapter 17A.

30   Sec. 24.  ROAD USE TAX FUND APPROPRIATION — OFFICE OF
31TREASURER OF STATE.
  There is appropriated from the road use
32tax fund created in section 312.1 to the office of treasurer of
33state for the fiscal year beginning July 1, 2023, and ending
34June 30, 2024, the following amount, or so much thereof as is
35necessary, to be used for the purposes designated:

4   Sec. 25.  IOWA UTILITIES BOARD.
   51.  There is appropriated from the commerce revolving fund
6created in section 546.12, as amended by 2023 Iowa Acts, Senate
7File 514, to the Iowa utilities board for the fiscal year
8beginning July 1, 2023, and ending June 30, 2024, the following
9amounts, or so much thereof as is necessary, to be used for the
10purposes designated:
   11For salaries, support, maintenance, and miscellaneous
12purposes, and for not more than the following full-time
13equivalent positions:

   162.  The utilities board may expend additional moneys,
17including moneys for additional personnel, if those additional
18expenditures are actual expenses which exceed the moneys
19budgeted for utility regulation and the expenditures are fully
20reimbursable. Before the board expends or encumbers an amount
21in excess of the moneys budgeted for regulation, the board
22shall first do all of the following:
   23a.  Notify the department of management, the legislative
24services agency, and the legislative fiscal committee of the
25need for the expenditures.
   26b.  File with each of the entities named in paragraph “a” the
27legislative and regulatory justification for the expenditures,
28along with an estimate of the expenditures.
29   Sec. 26.  CHARGES.  Each division of the department of
30insurance and financial services, the Iowa utilities board, and
31the office of consumer advocate shall include in its charges
32assessed or revenues generated an amount sufficient to cover
33the amount stated in its appropriation and any state-assessed
34indirect costs determined by the department of administrative
35services.

1   Sec. 27.  IOWA PRODUCTS.  As a condition of receiving an
2appropriation, any agency appropriated moneys pursuant to
3this division of this Act shall give first preference when
4purchasing a product to an Iowa product or a product produced
5by an Iowa-based business. Second preference shall be given
6to a United States product or a product produced by a business
7based in the United States.

9STANDING APPROPRIATIONS — LIMITATIONS
10   Sec. 28.  LIMITATION OF STANDING APPROPRIATION — FY
112023-2024.
  Notwithstanding the standing appropriation in the
12following designated section for the fiscal year beginning July
131, 2023, and ending June 30, 2024, the amount appropriated from
14the general fund of the state pursuant to that section for the
15following designated purpose shall not exceed the following
16amount:

18product manufacturers under section 453D.8:

20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill makes appropriations to certain state departments,
24agencies, funds, and certain other entities. The bill is
25organized by divisions.
   26GENERAL APPROPRIATIONS. The bill relates to and
27appropriates moneys to various state departments, agencies,
28and funds for FY 2023-2024. The bill makes appropriations to
29state departments and agencies including the department of
30administrative services, auditor of state, Iowa ethics and
31campaign disclosure board, offices of governor and lieutenant
32governor, department of inspections, appeals, and licensing,
33department of insurance and financial services, department of
34management, Iowa public employees’ retirement system, Iowa
35public information board, department of revenue, secretary of

   2STANDING APPROPRIATIONS — LIMITATIONS. The bill limits a
3standing appropriation for FY 2023-2024 for enforcement of Code
4chapter 453D relating to tobacco product manufacturers under
