Senate Study Bill 1195 - IntroducedA Bill ForAn Act 1relating to county or city legislation affecting dog

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 331.301, Code 2023, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  22.  A county shall not adopt, enforce,
4or otherwise administer an ordinance, motion, resolution, or
5amendment that restricts or hinders a person’s right to own or
6keep a dog based on the breed or perceived breed of the dog.
7This subsection does not inhibit the authority of a county to
8adopt, enforce, or administer an ordinance, motion, resolution,
9or amendment that applies to all dogs.
10   Sec. 2.  Section 364.3, Code 2023, is amended by adding the
11following new subsection:
12   NEW SUBSECTION.  18.  A city shall not adopt, enforce, or
13otherwise administer an ordinance, motion, resolution, or
14amendment that restricts or hinders a person’s right to own or
15keep a dog based on the breed or perceived breed of the dog.
16This subsection does not inhibit the authority of a city to
17adopt, enforce, or administer an ordinance, motion, resolution,
18or amendment that applies to all dogs.
19EXPLANATION
20The inclusion of this explanation does not constitute agreement with
21the explanation’s substance by the members of the general assembly.
   22This bill prohibits counties and cities from adopting,
23enforcing, or administering an ordinance, motion, resolution,
24or amendment that restricts or hinders a person’s right to own
25or keep a dog based on the breed or perceived breed of the dog.
26The bill does not inhibit the authority of a county or city to
27adopt, enforce, or administer an ordinance, motion, resolution,
28or amendment that applies to all dogs.
