Senate Study Bill 1170 - IntroducedA Bill ForAn Act 1relating to persons authorized to receive a copy of a
2written accident report filed by a law enforcement officer.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.271, subsection 2, Code 2023, is
2amended to read as follows:
   32.  All written reports filed by a law enforcement officer
4as required under section 321.266 shall be made available to
5any party to an accident, the party’s insurance company or
6its agent, the party’s attorney, the federal motor carrier
7safety administration, or the attorney general, on written
8request to the department and the payment of a fee of four
9dollars for each copy. If a copy of an investigating officer’s
10report of a motor vehicle accident filed with the department
11is retained by the law enforcement agency of the officer
12who filed the report, a copy shall be made available to any
13party to the accident, the party’s insurance company or its
14agent, the party’s attorney, the federal motor carrier safety
15administration, other law enforcement agencies, or the attorney
16general, on written request and the payment of a fee. However,
17the attorney general and the federal motor carrier safety
18administration shall not be required by the department or the
19law enforcement agency to pay a fee for a copy of a report filed
20by a law enforcement or investigating officer.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill authorizes a copy of a written report that
25was filed with the department of transportation by a law
26enforcement officer who investigated a motor vehicle accident
27which resulted in injury to or death of any person or total
28property damage to an apparent extent of $1,500 or more, and
29that was retained by the agency of the officer who filed the
30report, to be made available to other law enforcement agencies.
31The bill does not apply this authorization to such reports that
32were not retained by the agency of the officer.
   33Under current law, a person eligible to receive a copy of
34the report, other than the attorney general or federal motor
35carrier safety administration, must make a written request and
