3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 103A.7, subsection 2, paragraph f, Code
22023, is amended by striking the paragraph.
3   Sec. 2.  Section 103A.8, subsection 7, Code 2023, is amended
4by striking the subsection.
5   Sec. 3.  Section 103A.10, subsections 4 and 5, Code 2023, are
6amended by striking the subsections.
7   Sec. 4.  Section 103A.10A, subsections 1 and 2, Code 2023,
8are amended to read as follows:
   91.  All newly constructed buildings or structures subject to
10the state building code, including any addition, but excluding
11any renovation or repair of such a building or structure, owned
12by the state or an agency of the state, except as provided in
13subsection 2, shall be subject to a plan review and inspection
14by the commissioner or an independent building inspector
15appointed by the commissioner. Any renovation or repair
16of such a building or structure shall be subject to a plan
17review, except as provided in subsection 2. A fee shall be
18assessed for the cost of plan review, and, if applicable, the
19cost of inspection. The commissioner may inspect an existing
20building that is undergoing renovation or remodeling to enforce
21the energy conservation requirements established under this
22chapter.

   232.  All newly constructed buildings, including any addition,
24but excluding any renovation or repair of a building, owned by
25the state board of regents shall be subject to a plan review
26and inspection by the commissioner or the commissioner’s
27staff or assistant. A renovation of a building owned by the
28state board of regents shall be subject to a plan review.
29The commissioner may inspect an existing building that is
30undergoing renovation or remodeling to enforce the energy
31conservation requirements established under this chapter.
The
32commissioner and the state board of regents shall develop a
33plan to implement this provision.
34   Sec. 5.  Section 103A.19, subsection 1, Code 2023, is amended
35to read as follows:
-1-   11.  The examination and approval or disapproval of plans
2and specifications, the issuance and revocation of building
3permits, licenses, certificates, and similar documents, the
4inspection of buildings or structures, and the administration
5and enforcement of building regulations shall be the
6responsibility of the governmental subdivisions of the
7state and shall be administered and enforced in the manner
8prescribed by local law or ordinance. All provisions of
9law relating to the administration and enforcement of local
10building regulations in any governmental subdivision shall be
11applicable to the administration and enforcement of the state
12building code in the governmental subdivision. An application
13made to a local building department or to a state agency for
14permission to construct a building or structure pursuant to the
15provisions of the state building code shall, in addition to
16any other requirement, be signed by the owner or the owner’s
17authorized agent, and shall contain the address of the owner,
18and a statement that the application is made for permission to
19construct in accordance with the provisions of the code. The
20application shall also specifically include a statement that
21the construction will be in accordance with all applicable
22energy conservation requirements.

23   Sec. 6.  Section 103A.19, subsection 3, Code 2023, is amended
24by striking the subsection.
25   Sec. 7.  Section 103A.22, subsection 1, Code 2023, is amended
26to read as follows:
   271.  Nothing in this chapter shall be construed as prohibiting
28any governmental subdivision from adopting or enacting any
29building regulations relating to any building or structure
30within its limits, but a governmental subdivision in which
31the state building code has been accepted and is applicable
32shall not have the power to supersede, void, or repeal or make
33more restrictive any of the provisions of this chapter or of
34the rules adopted by the commissioner. This subsection shall
35not apply to energy conservation requirements adopted by the
-2-1commissioner and approved by the council pursuant to section
2103A.8A or 103A.10.

3   Sec. 8.  Section 331.361, subsection 5, paragraph b, Code
42023, is amended by striking the paragraph.
5   Sec. 9.  REPEAL.  Section 103A.8A, Code 2023, is repealed.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9This bill repeals a requirement that the state building
10code commissioner adopt energy conservation requirements for
11new single-family and two-family residential construction.
12The bill strikes provisions applying the energy conservation
13requirements to other construction in the state and requiring
14compliance with energy conservation requirements.
