4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 327G.25, Code 2023, is amended to read
2as follows:
3327G.25 Closing of crossing for repair or upgrade.
4A railway corporation shall not close a railway crossing
5to the traveling public for more than thirty twenty days for
6the purpose of repairing or upgrading the crossing. A railway
7corporation violating this section shall, upon conviction, be
8subject to a schedule “one” penalty under section 327C.5.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
12This bill reduces the number of days a railway corporation is
13authorized to close a railway crossing for repair or upgrade
14from 30 days to 20 days. By operation of law, a violation
15of the bill is a schedule “one” penalty, a fine of $100 per
16violation.
