4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 362.10, Code 2023, is amended by striking
2the section and inserting in lieu thereof the following:
   3362.10  Police officers and fire fighters.
   4The maximum age for a regular law enforcement officer, as
5defined in section 80B.3, police officer, or marshal, employed
6full-time or part-time for police or law enforcement duties,
7or a paid professional fire fighter, employed full-time
8or part-time for the duty of fighting fires, is sixty-five
9years of age. This section does not apply to a reserve peace
10officer, as defined in section 80D.1A, or to a volunteer fire
11fighter.
12   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
13importance, takes effect upon enactment.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill relates to the maximum employment age for certain
18city public safety positions. Under current law, the maximum
19age for a city police officer, marshal, or fire fighter
20employed for police duty or the duty of fighting fires is 65
21years of age. The maximum employment age does not apply to
22volunteer fire fighters. The bill sets a maximum employment
23age of 65 for city law enforcement officers, in addition to
24those positions currently subject to the maximum employment
25age, and provides that the maximum employment age applies
26to any included position regardless of whether the person's
27employment is full-time or part-time. The bill states that the
28maximum employment age does not apply to reserve peace officers
29in addition to volunteer fire fighters.
   30The bill takes effect upon enactment.
