3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.453, subsection 1, Code 2023, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  e.  Hydroexcavation equipment used primarily
4for digging and excavation when moved or moving upon a highway
5that is not a portion of the interstate.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9Code section 321.453(1) exempts certain motor vehicles and
10equipment from most provisions of Code chapter 321 (motor
11vehicles and law of the road) governing size, weight, and load,
12and the permit requirements of Code chapter 321E (vehicles of
13excessive size and weight). Such motor vehicles and equipment
14include fire apparatus, certain road maintenance equipment,
15implements of husbandry when moved or moving upon a highway
16that is not a portion of the interstate, and certain equipment
17used primarily for construction of permanent conservation
18practices on agricultural land when moved or moving upon a
19highway that is not a portion of the interstate. This bill
20adds hydroexcavation equipment used primarily for digging and
21excavation to the list of exempt motor vehicles and equipment,
22when such vehicles are moved or moving upon a highway that is
23not a portion of the interstate.
   24Motor vehicles and equipment listed in Code section
25321.453(1) are not exempt from the provisions of Code section
26321.463 (maximum gross weight), 321.471 (restrictions by local
27authorities), or 321.474 (restrictions by the department of
28transportation), which include a number of weight restrictions
29and certain permit provisions.
   30Under Code section 321.453(2), exempted implements of
31husbandry and agricultural conservation equipment are subject
32to additional lighting, warning flag, and time-of-day operation
33requirements. The bill does not add hydroexcavation equipment
34to this provision.
