House Study Bill 86 - IntroducedA Bill ForAn Act 1relating to the driving privileges of persons holding
2a special minor’s driver’s license, and making penalties
3applicable.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.194, subsection 2, paragraph a, Code
22023, is amended by adding the following new subparagraph:
3   NEW SUBPARAGRAPH.  (04)  (a)  A licensee carrying proof
4of authorization as provided in subparagraph division (b)
5may operate a motor vehicle during the hours of 5:00 a.m.to
610:00 p.m.over the most direct and accessible route between
7the licensee’s residence and the residence of any grandparent
8of the licensee, provided the driving distance between the
9licensee’s residence and the destination is no more than fifty
10miles.
   11(b)  The school board, superintendent, or principal of the
12licensee’s school may authorize the licensee to operate a motor
13vehicle pursuant to this subparagraph. If such authorization
14is granted, the school board, superintendent, or principal, as
15applicable, shall provide the licensee proof of authorization
16on a form prescribed by the department.
17   Sec. 2.  Section 321.194, subsection 2, paragraph a,
18subparagraph (4), Code 2023, is amended to read as follows:
   19(4)  To a service station for the purpose of refueling, so
20long as the service station is the station closest to the route
21on which the licensee is traveling under subparagraph (1), (2),
22or (3)
 this paragraph.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
   26Under current law, a person issued a special minor’s
27driver’s license is generally allowed to operate a motor
28vehicle during the hours of 5:00 a.m.to 10:00 p.m.between,
29among other locations, the licensee’s residence, school of
30enrollment, bus stops, certain other sites, facilities, or
31schools for certain extracurricular activities, locations for
32farm work, and fuel stations.
   33This bill authorizes a licensee to operate a motor vehicle
34during the hours of 5:00 a.m.to 10:00 p.m.over the most
35direct and accessible route between the licensee’s residence
-1-1and the residence of any grandparent of the licensee, provided
2the licensee is authorized to do so by the licensee’s school
3board, superintendent, or principal, the licensee carries proof
4of such authorization in the vehicle, and the driving distance
5between the licensee’s residence and the destination is no more
6than 50 miles.
   7If the school board, superintendent, or principal authorizes
8the licensee in accordance with the bill, the school board,
9superintendent, or principal, as applicable, is required to
10provide the licensee with proof of authorization on a form
11prescribed by the department of transportation.
   12A violation of Code section 321.194 is punishable by a
13scheduled fine of $70.
