3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  321.260A  Rumble strips.
   21.  As used in this section, “rumble strips” means a series
3of rough-textured, slightly raised or depressed grooves
4along the surface of a roadway used to alert motor vehicle
5operators about upcoming road conditions, including an upcoming
6traffic-control signal or device.
   72.  Any governmental entity which exercises jurisdiction
8over a highway under section 306.4 shall construct and maintain
9rumble strips in advance of all stop signs and traffic-control
10signals located on a highway under the governmental entity’s
11control where the highway enters or crosses a primary highway.
12This subsection does not apply if the segment of the highway
13on which the rumble strips would be constructed is unpaved,
14is inside the limits of any incorporated city, is within two
15hundred yards of a person’s bona fide residence dwelling, or
16has a speed limit of less than fifty-five miles per hour.
17   Sec. 2.  STATE MANDATE FUNDING SPECIFIED.  In accordance
18with section 25B.2, subsection 3, the state cost of requiring
19compliance with any state mandate included in this Act shall
20be paid by a political subdivision from road use tax fund
21moneys received by the political subdivision under chapter 310,
22312, or 312A. This specification of the payment of the state
23cost shall be deemed to meet all of the state funding-related
24requirements of section 25B.2, subsection 3, and no additional
25state funding shall be necessary for the full implementation of
26this Act by and enforcement of this Act against all affected
27political subdivisions.
28EXPLANATION
29The inclusion of this explanation does not constitute agreement with
30the explanation’s substance by the members of the general assembly.
   31This bill requires any governmental entity which exercises
32jurisdiction over a highway to construct and maintain rumble
33strips on certain highways. The bill defines the term “rumble
34strips”. Under the bill, rumble strips are required in advance
35of all stop signs and traffic-control signals located on a
-1-1highway where the highway enters or crosses a primary highway.
2However, rumble strips are not required if the segment of
3highway is unpaved, is inside the limits of any incorporated
4city, is within 200 yards of a person’s bona fide residence
5dwelling, or has a speed limit of less than 55 miles per hour.
   6The bill may include a state mandate as defined in Code
7section 25B.3. The bill requires that the state cost of any
8state mandate included in the bill be paid by a political
9subdivision from road use tax fund moneys received by
10the political subdivision. The specification is deemed
11to constitute state compliance with any state mandate
12funding-related requirements of Code section 25B.2. The
13inclusion of this specification is intended to reinstate the
14requirement of political subdivisions to comply with any state
15mandates included in the bill.
