3and providing penalties.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 235E.2, subsection 9, Code 2023, is
2amended to read as follows:
   39.  a.  A person required by this section to report a
4suspected case of dependent adult abuse pursuant to subsection
52 who knowingly and willfully fails to do so within twenty-four
6hours commits a simple misdemeanor.
   7b.  A person required by subsection 2 to report a suspected
8case of dependent adult abuse who knowingly fails to do so or
9who knowingly interferes with the making of such a report or
10applies a requirement that results in such a failure is civilly
11liable for the damages proximately caused by the failure.
   12c.  A person who reports or causes to be reported false
13information regarding a suspected case of dependent adult abuse
14pursuant to subsection 2, knowing that the information is false
15or that the abuse did not occur, commits a simple misdemeanor.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill relates to the reporting of false information
20regarding suspected dependent adult abuse in facilities and
21programs.
   22The bill provides that a person who reports or causes to
23be reported false information regarding a suspected case of
24dependent adult abuse, knowing that the information is false
25or that the abuse did not occur, commits a simple misdemeanor.
26A simple misdemeanor is punishable by confinement for no more
27than 30 days and a fine of at least $105 but not more than $855.
