3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 331.301, Code 2023, is amended by adding
2the following new subsection:
3 NEW SUBSECTION. 22. A county shall not adopt, enforce,
4or otherwise administer an ordinance, motion, resolution,
5or amendment providing for any terms or conditions of storm
6water regulation that exceed or conflict with federal or
7state statutes or regulations relating to storm water runoff,
8discharge, retention, or management.
9 Sec. 2. Section 364.3, Code 2023, is amended by adding the
10following new subsection:
11 NEW SUBSECTION. 18. A city shall not adopt, enforce,
12or otherwise administer an ordinance, motion, resolution,
13or amendment providing for any terms or conditions of storm
14water regulation that exceed or conflict with federal or
15state statutes or regulations relating to storm water runoff,
16discharge, retention, or management.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
20This bill prohibits a county or city from adopting,
21enforcing, or otherwise administering an ordinance, motion,
22resolution, or amendment providing for any terms or conditions
23of storm water regulation that exceed or conflict with federal
24or state statutes or regulations relating to storm water
25runoff, discharge, retention, or management.
