2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  70A.21  Donated leave for immediate
2family members.
   31.  For purposes of this section:
   4a.  “Donated leave” means vacation and sick leave hours
5donated to an eligible recipient.
   6b.  “Eligible recipient” means an eligible state employee’s
7spouse, parent, son, or daughter who is also an eligible state
8employee.
   9c.  “Eligible state employee” means a full-time or part-time
10state employee who is eligible to accrue vacation.
   112.  Eligible state employees are allowed to donate leave
12hours to an eligible recipient. Contributions shall be
13designated as donated leave and shall be subject to the
14requirements of this section.
   153.  An eligible state employee shall be allowed to donate
16leave to an eligible recipient subject to the following
17requirements:
   18a.  Vacation and sick leave hours shall be donated in
19whole-hour increments; however, vacation and sick leave
20hours may be credited to the eligible recipient in other than
21whole-hour increments. Donated vacation hours shall not
22exceed the maximum allowable vacation hours for the eligible
23recipient.
   24b.  Donated leave hours will be credited in increments not to
25exceed the eligible employee’s regularly scheduled work hours
26on a pay-period-by-pay-period basis.
   27c.  Approval of use of donated leave shall be for a period
28not to exceed one year either on an intermittent or continuous
29basis for each occurrence.
   30d.  Donated leave shall be irrevocable after it is credited
31to the eligible recipient. Donated leave hours not credited to
32the eligible recipient will not be deducted from the donor’s
33vacation or sick leave balance.
34EXPLANATION
35The inclusion of this explanation does not constitute agreement with

   2This bill allows a full-time or part-time state employee
3who is eligible to accrue vacation to donate vacation and
4sick leave hours to an eligible recipient, defined as that
5employee’s spouse, parent, son, or daughter who is also a state
6employee.
   7The bill allows vacation and sick leave hours to be donated
8to an eligible recipient. The bill provides that donated
9vacation hours shall not exceed the maximum allowable vacation
10hours for the eligible recipient. The bill provides that
11approval of use of donated leave shall be for a period not to
12exceed one year and that donated vacation and sick leave shall
13be irrevocable after it is credited to the eligible recipient.
