1.
FAMILY-FOCUSED
SUBSTANCE
USE
DISORDER
TREATMENT

AND
PROGRAMMING
——
APPROPRIATION.
2
1.
The
department
of
health
and
human
services
shall
3
create
a
family-focused
substance
use
disorder
treatment
and
4
programming
grant
program
to
provide
grants
to
nonprofit
5
organizations
that
provide
such
treatment
and
programming
6
throughout
the
state.
The
department
shall
adopt
rules
7
pursuant
to
chapter
17A
to
administer
the
program
including
8
but
not
limited
to
rules
regarding
requirements
for
eligible
9
programs,
grant
applications,
any
licensing
requirements
10
applicable
to
eligible
programs,
matching
fund
requirements,
11
and
the
duration
and
maximum
amount
of
a
grant.

2.
To
be
eligible
for
a
grant,
a
nonprofit
organization
13
shall
secure
the
commitment
of
a
local
government
to
provide
14
matching
funds
of
one
dollar
to
every
two
dollars
of
state
15
funding
provided
for
the
grant.
A
local
government
that
16
receives
opioid
settlement
funds
directly
as
a
result
of
17
a
national
settlement
of
litigation
with
entities
that
18
manufactured,
marketed,
sold,
distributed,
dispensed,
or
19
promoted
opioids,
made
in
connection
with
claims
arising
20
from
the
manufacturing,
marketing,
selling,
distributing,
21
dispensing,
or
promoting
of
opioids,
may
use
such
funds
as
the
22
match
of
state
funds
for
a
grant.

3.
For
the
purposes
of
this
section:
24
a.
“Family-focused
substance
use
disorder
treatment
and
25
programming”
includes
programs
that
afford
the
opportunity
26
for
a
person
with
a
substance
use
disorder
to
recover
in
an
27
environment
that
meets
the
person’s
needs
by
including
children
28
and
other
family
members
in
the
treatment
process,
providing
29
family-based
clinical
care,
and
providing
supportive
and
30
community-based
services
including
child
care,
transportation,
31
home
visiting,
mental
health
services,
a
medical
home,
32
employment
training,
housing,
ongoing
support,
and
linkages
to
33
other
financial
aid
and
human
services
programs,
specific
to
34
the
person.

government”
includes
a
county,
city,
or
other

local
government
entity
within
the
geographic
boundaries
of
the

There
is
appropriated
from
the
opioid
settlement
fund
4
created
in
section
12.51
to
the
department
of
health
and
human

services
for
the
fiscal
year
beginning
July
1,
2023,
and
ending
6
June
30,
2024,
the
following
amount,
or
so
much
thereof
as
is
7
necessary,
to
be
used
for
the
family-focused
substance
use
8
disorder
treatment
and
programming
grant
program
as
described

in
this
section:

Notwithstanding
section
8.33,
moneys
appropriated
in
this
12
section
that
remain
unencumbered
or
unobligated
at
the
close
of
13
the
fiscal
year
shall
not
revert
but
shall
remain
available
for
14
expenditure
for
the
purposes
designated
until
the
close
of
the
15
succeeding
fiscal
year.

EXPLANATION
17
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.
19
This
bill
requires
the
department
of
health
and
human
20
services
(HHS)
to
create
a
family-focused
substance
use
21
disorder
treatment
and
programming
grant
program
to
provide
22
grants
to
nonprofit
organizations
that
provide
such
treatment
23
and
programming.
The
department
shall
adopt
administrative
24
rules
to
administer
the
program.
To
be
eligible
for
a
grant,
a
25
nonprofit
organization
shall
secure
the
commitment
of
a
local
26
government
to
provide
a
2:1
match
of
local
funds
to
state
27
funds
for
the
grant.
A
local
government
that
receives
opioid
28
settlement
funds
directly
as
a
result
of
a
national
settlement
29
may
use
the
funds
as
the
match
of
state
funds
for
a
grant.

The
bill
defines
the
terms
“family-focused
substance
use
31
disorder
treatment
and
programming”
and
“local
government”
for
32
the
purposes
of
the
bill.
33
The
bill
appropriates
$2
million
from
the
opioid
settlement
34
fund
created
in
Code
section
12.51
to
HHS
for
FY
2023-2024
to

Moneys
appropriated
that
remain
