S.F. 2115 Section 1. Section 331.301, subsection 17, Code 2022, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0d. Notwithstanding paragraph “b” , a county 3 may enact or enforce an ordinance that regulates or limits, 4 but does not prohibit, short-term rental properties that are 5 located within one mile of a lake that is accessible to the 6 public or owned by the state. 7 Sec. 2. Section 414.1, subsection 1, paragraph e, Code 2022, 8 is amended by adding the following new subparagraph: 9 NEW SUBPARAGRAPH . (04) Notwithstanding subparagraph (2), 10 a city may enact or enforce an ordinance that regulates or 11 limits, but does not prohibit, short-term rental properties 12 that are located within one mile of a lake that is accessible 13 to the public or owned by the state. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to the regulation of certain short-term 18 rental properties by counties and cities. 19 Current law prohibits a county or city from adopting or 20 enforcing any regulation, restriction, or other ordinance, 21 including a conditional use permit requirement, relating to 22 short-term rental properties within the respective county or 23 city. Current law provides some exceptions to the prohibition 24 if enforcement is performed in the same manner as enforcement 25 applicable to similar properties that are not short-term rental 26 properties. The bill provides an additional exception, not 27 subject to the enforcement limitation, that allows a county or 28 city to enact or enforce an ordinance that regulates or limits, 29 but does not prohibit, short-term rental properties that are 30 located within one mile of a lake that is accessible to the 31 public or owned by the state. 32 -1- LSB 5867XS (2) 89 js/ns 1/ 1
