GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 5 1. For the fiscal year beginning July 1, 2020, the goals 6 for the economic development authority shall be to expand and 7 stimulate the state economy, increase the wealth of Iowans, and 8 increase the population of the state. 9 2. To achieve the goals in subsection 1, the economic 10 development authority shall do all of the following for the 11 fiscal year beginning July 1, 2020: 12 a. Concentrate its efforts on programs and activities that 13 result in commercially viable products and services. 14 b. Adopt practices and services consistent with free 15 market, private sector philosophies. 16 c. Ensure economic growth and development throughout the 17 state. 18 d. Work with businesses and communities to continually 19 improve the economic development climate along with the 20 economic well-being and quality of life for Iowans. 21 e. Coordinate with other state agencies to ensure that they 22 are attentive to the needs of an entrepreneurial culture. 23 f. Establish a strong and aggressive marketing image to 24 showcase Iowa’s workforce, existing industry, and potential. 25 A priority shall be placed on recruiting new businesses, 26 business expansion, and retaining existing Iowa businesses. 27 Emphasis shall be placed on entrepreneurial development through 28 helping entrepreneurs secure capital, and developing networks 29 and a business climate conducive to entrepreneurs and small 30 businesses. 31 g. Encourage the development of communities and quality of 32 life to foster economic growth. 33 h. Prepare communities for future growth and development 34 through development, expansion, and modernization of 35 -2- LSB 5011XG (9) 88 ko/tm 2/ 20

Develop public-private partnerships with Iowa businesses 2 in the tourism industry, Iowa tour groups, Iowa tourism 3 organizations, and political subdivisions in this state to 4 assist in the development of advertising efforts. 5 j. Develop, to the fullest extent possible, cooperative 6 efforts for advertising with contributions from other sources. 7 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 8 1. APPROPRIATION 9 a. There is appropriated from the general fund of the state 10 to the economic development authority for the fiscal year 11 beginning July 1, 2020, and ending June 30, 2021, the following 12 amount, or so much thereof as is necessary, to be used for the 13 purposes designated in this subsection: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 13,898,101 15 b. (1) For salaries, support, miscellaneous purposes, 16 programs, marketing, and the maintenance of an administration 17 division, a business development division, a community 18 development division, a small business development division, 19 and other divisions the authority may organize. 20 (2) For business development operations and programs, 21 international trade, export assistance, workforce recruitment, 22 and the partner state program. 23 (3) For transfer to a fund created pursuant to section 24 15.313 for purposes of financing strategic infrastructure 25 projects. 26 (4) For community economic development programs, tourism 27 operations, community assistance, plans for Iowa green corps 28 and summer youth programs, the mainstreet and rural mainstreet 29 programs, the school-to-career program, the community 30 development block grant, and housing and shelter-related 31 programs. 32 (5) For achieving the goals and accountability, and 33 fulfilling the requirements and duties required under this Act. 34 c. Notwithstanding section 8.33, moneys appropriated in 35 -3- LSB 5011XG (9) 88 ko/tm 3/ 20
S.F. _____ H.F. _____ this subsection that remain unencumbered or unobligated at the 1 close of the fiscal year shall not revert but shall remain 2 available for expenditure for the purposes designated in this 3 subsection until the close of the succeeding fiscal year. 4 2. FINANCIAL ASSISTANCE RESTRICTIONS 5 a. A business creating jobs through moneys appropriated in 6 subsection 1 shall be subject to contract provisions requiring 7 new and retained jobs to be filled by individuals who are 8 citizens of the United States who reside within the United 9 States or any person authorized to work in the United States 10 pursuant to federal law, including legal resident aliens in the 11 United States. 12 b. Any vendor who receives moneys appropriated in 13 subsection 1 shall adhere to such contract provisions and 14 provide periodic assurances as the state shall require that the 15 jobs are filled solely by citizens of the United States who 16 reside within the United States or any person authorized to 17 work in the United States pursuant to federal law, including 18 legal resident aliens in the United States. 19 c. A business that receives financial assistance from 20 the authority from moneys appropriated in subsection 1 shall 21 only employ individuals legally authorized to work in this 22 state. In addition to all other applicable penalties provided 23 by current law, all or a portion of the assistance received 24 by a business which is found to knowingly employ individuals 25 not legally authorized to work in this state is subject to 26 recapture by the authority. 27 3. USES OF APPROPRIATIONS 28 a. From the moneys appropriated in subsection 1, the 29 authority may provide financial assistance in the form of a 30 grant to a community economic development entity for conducting 31 a local workforce recruitment effort designed to recruit former 32 citizens of the state and former students at colleges and 33 universities in the state to meet the needs of local employers. 34 b. From the moneys appropriated in subsection 1, the 35 -4- LSB 5011XG (9) 88 ko/tm 4/ 20
S.F. _____ H.F. _____ authority may provide financial assistance to early stage 1 industry companies being established by women entrepreneurs. 2 c. From the moneys appropriated in subsection 1, the 3 authority may provide financial assistance in the form of 4 grants, loans, or forgivable loans for advanced research and 5 commercialization projects involving value-added agriculture, 6 advanced technology, or biotechnology. 7 d. The authority shall not use any moneys appropriated in 8 subsection 1 for purposes of providing financial assistance for 9 the Iowa green streets pilot project or for any other program 10 or project that involves the installation of geothermal systems 11 for melting snow and ice from streets or sidewalks. 12 4. IOWA COMMISSION ON VOLUNTEER SERVICE 13 There is appropriated from the general fund of the state 14 to the economic development authority for the fiscal year 15 beginning July 1, 2020, and ending June 30, 2021, the following 16 amount for allocation to the Iowa commission on volunteer 17 service for purposes of the Iowa state commission grant 18 program, and the Iowa’s promise and Iowa mentoring partnership 19 programs: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 168,201 21 Of the moneys appropriated in this subsection, the 22 authority shall allocate $75,000 for purposes of the Iowa state 23 commission grant program and $93,201 for purposes of the Iowa’s 24 promise and Iowa mentoring partnership programs. 25 Notwithstanding section 8.33 , moneys appropriated in this 26 subsection that remain unencumbered or unobligated at the close 27 of the fiscal year shall not revert but shall remain available 28 for expenditure for the purposes designated until the close of 29 the succeeding fiscal year. 30 5. COUNCILS OF GOVERNMENTS —— ASSISTANCE 31 There is appropriated from the general fund of the state 32 to the economic development authority for the fiscal year 33 beginning July 1, 2020, and ending June 30, 2021, the following 34 amount to be used for the purposes of providing financial 35 -5- LSB 5011XG (9) 88 ko/tm 5/ 20

FUTURE READY IOWA REGISTERED APPRENTICESHIP DEVELOPMENT 3 PROGRAM 4 a. There is appropriated from the general fund of the state 5 to the economic development authority for the fiscal year 6 beginning July 1, 2020, and ending June 30, 2021, the following 7 amount to be used for the funding of the future ready Iowa 8 registered apprenticeship development program under chapter 9 15C, to encourage small to midsize businesses to start or grow 10 registered apprenticeships: 11 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,600,000 12 b. Notwithstanding section 8.33, moneys appropriated in 13 this subsection that remain unencumbered or unobligated at the 14 close of the fiscal year shall not revert but shall remain 15 available for expenditure for the purposes designated until the 16 close of the succeeding fiscal year. 17 7. SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS 18 INTERNSHIPS 19 a. There is appropriated from the Iowa skilled worker and 20 job creation fund created in section 8.75 to the Iowa economic 21 development authority for the fiscal year beginning July 1, 22 2020, and ending June 30, 2021, the following amount, or so 23 much thereof as is necessary, for the purposes designated: 24 For the funding of internships for students studying in the 25 fields of science, technology, engineering, and mathematics 26 with eligible Iowa employers as provided in section 15.411, 27 subsection 3, paragraph “c”: 28 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 29 b. No more than 3 percent of the moneys appropriated in this 30 subsection may be used by the authority for costs associated 31 with administration of the internship program. 32 c. There is appropriated from the Iowa skilled worker and 4 job creation fund created in section 8.75 to the economic 5 development authority for the fiscal year beginning July 1, 6 2020, and ending June 30, 2021, the following amount, or so 7 much thereof as is necessary, for the purpose designated: 8 For allocation to the Iowa commission on volunteer services 9 to be used for further development of a volunteer mentor 10 program to support implementation of the future ready Iowa 11 skilled workforce last-dollar scholarship program in section 12 261.131 and the future ready Iowa skilled workforce grant 13 program created in section 261.132: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 400,000 15 b. EMPOWER RURAL IOWA —— HOUSING NEEDS ASSESSMENT GRANT 21 PROGRAM 22 a. There is appropriated from the Iowa skilled worker and 23 job creation fund created in section 8.75 to the economic 24 development authority for the fiscal year beginning July 1, 25 2020, and ending June 30, 2021, the following amount, or so 26 much thereof as is necessary, for the purpose designated: 27 To be distributed by the authority for establishing a 28 housing needs assessment grant program to provide small 29 communities with hard data and housing-related information 30 specific to the community being analyzed: 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 32 b. The authority shall adopt rules pursuant to chapter 3 17A to establish criteria for the distribution of the moneys 4 appropriated in this subsection. 5 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS —— FY 6 2020-2021. Notwithstanding the standing appropriations 7 in the following designated sections for the fiscal year 8 beginning July 1, 2020, and ending June 30, 2021, the amounts 9 appropriated from the general fund of the state pursuant to 10 these sections for the following purposes shall not exceed the 11 following amounts: 12 1. For operational support grants and community cultural 13 grants under section 99F.11, subsection 3, paragraph “d”, 14 subparagraph (1): 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 448,403 16 2. FINANCIAL ASSISTANCE REPORTING —— ECONOMIC 20 DEVELOPMENT AUTHORITY. The economic development authority and 21 the department of revenue shall submit a joint annual report 22 to the general assembly no later than November 1, 2020, that 23 details the amount of every direct loan, forgivable loan, 24 tax credit, tax exemption, tax refund, grant, or any other 25 financial assistance awarded to a person during the prior 26 fiscal year by the authority under an economic development 27 program administered by the authority. The report shall 28 identify the county where the project associated with each such 29 award is located. 30 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the 31 moneys collected by the insurance division in excess of the 32 anticipated gross revenues under section 505.7, subsection 33 3 , during the fiscal year beginning July 1, 2020, $100,000 34 shall be transferred to the economic development authority for 35 -8- LSB 5011XG (9) 88 ko/tm 8/ 20
S.F. _____ H.F. _____ insurance economic development and international insurance 1 economic development. 2 Sec. 7. IOWA FINANCE AUTHORITY. 3 1. There is appropriated from the general fund of the state 4 to the Iowa finance authority for the fiscal year beginning 5 July 1, 2020, and ending June 30, 2021, the following amount, 6 or so much thereof as is necessary, to be used to provide 7 reimbursement for rent expenses to eligible persons under 8 the home and community-based services rent subsidy program 9 established in section 16.55: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 11 2. Of the moneys appropriated in this section, not more than 12 $35,000 may be used for administrative costs. 13 3. Notwithstanding section 8.33, moneys appropriated in 14 this section that remain unencumbered or unobligated at the 15 close of the fiscal year shall not revert but shall remain 16 available for expenditure for the purposes designated until the 17 close of the succeeding fiscal year. 18 Sec. 8. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 19 is requested to review the audit of the Iowa finance authority 20 performed by the auditor hired by the authority. 21 Sec. 9. PUBLIC EMPLOYMENT RELATIONS BOARD. 22 1. There is appropriated from the general fund of the state 23 to the public employment relations board for the fiscal year 24 beginning July 1, 2020, and ending June 30, 2021, the following 25 amount, or so much thereof as is necessary, for the purposes 26 designated: 27 For salaries, support, maintenance, and miscellaneous 28 purposes: 29 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,509,978 30 2. DIVISION OF LABOR SERVICES 6 a. From the contractor registration fees, the division of 10 labor services shall reimburse the department of inspections 11 and appeals for all costs associated with hearings under 12 chapter 91C , relating to contractor registration. 13 2. DIVISION OF WORKERS’ COMPENSATION 14 a. The division of workers’ compensation shall charge a 18 $100 filing fee for workers’ compensation cases. The filing 19 fee shall be paid by the petitioner of a claim. However, the 20 fee can be taxed as a cost and paid by the losing party, except 21 in cases where it would impose an undue hardship or be unjust 22 under the circumstances. The moneys generated by the filing 23 fee allowed under this subsection are appropriated to the 24 department of workforce development to be used for purposes of 25 administering the division of workers’ compensation. 26 3. WORKFORCE DEVELOPMENT OPERATIONS 27 a. GENERAL FUND —— EMPLOYEE MISCLASSIFICATION 27 PROGRAM. FUTURE READY IOWA —— IOWA EMPLOYER INNOVATION FUND. 13 1. There is appropriated from the general fund of the state 14 to the department of workforce development for the fiscal year 15 beginning July 1, 2020, and ending June 30, 2021, the following 16 amount, or so much thereof as is necessary, to be used for the 17 purposes designated: 18 In consultation with the workforce development board, for 19 funding of the Iowa employer innovation program which shall 20 match eligible employer moneys to expand opportunities for 21 education and training leading to high-demand jobs and to 22 encourage Iowa employers, community leaders, and others to 23 provide leadership and support for regional workforce talent 24 pools throughout the state, and for future ready Iowa education 25 and outreach: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,000,000 27 Of the moneys appropriated in this subsection, an amount 28 to be determined by the department of workforce development 29 in consultation with the workforce development board shall be 30 transferred to the Iowa child care challenge fund. 31 2. VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES. The 11 department of workforce development shall require a unique 12 identification login for all users of workforce development 13 centers operated through electronic means. 14 Sec. 16. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 15 section 96.9, subsection 4 , paragraph “a”, moneys credited to 16 the state by the secretary of the treasury of the United 17 States pursuant to section 903 of the Social Security 18 Act are appropriated to the department of workforce 19 development and shall be used by the department for the 20 administration of the unemployment compensation program only. 21 This appropriation shall not apply to any fiscal year 22 beginning after December 31, 2020. 23 Sec. 17. IOWA SKILLED WORKER AND JOB CREATION FUND. 24 1. There is appropriated from the Iowa skilled worker and 25 job creation fund created in section 8.75 to the following 26 departments, agencies, and institutions for the fiscal year 27 beginning July 1, 2020, and ending June 30, 2021, the following 28 amounts, or so much thereof as is necessary, to be used for the 29 purposes designated: 30 a. STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS 11 (1) STATE BOARD OF REGENTS. For capacity building 12 infrastructure in areas related to technology 13 commercialization, marketing and business development 14 efforts in areas related to technology commercialization, 15 entrepreneurship, and business growth, and infrastructure 16 projects and programs needed to assist in implementation of 17 activities under chapter 262B: 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 19 (a) Of the moneys appropriated pursuant to this 20 subparagraph (1), 35 percent shall be allocated for Iowa state 21 university of science and technology, 35 percent shall be 22 allocated for the state university of Iowa, and 30 percent 23 shall be allocated for the university of northern Iowa. 24 (b) The institutions shall provide a one-to-one match 25 of additional moneys for the activities funded with moneys 26 appropriated under this subparagraph (1). 27 (c) The state board of regents shall submit a report by 28 January 15, 2021, to the governor, the general assembly, and 29 the legislative services agency regarding the activities, 30 projects, and programs funded with moneys appropriated under 31 this subparagraph (1). The report shall be provided in an 32 electronic format and shall include a list of metrics and 33 criteria mutually agreed to in advance by the board of regents 34 and the economic development authority. Iowa state university of science and 14 technology may allocate the appropriated moneys to the various 15 small business development centers in any manner necessary to 16 achieve the purposes of this subparagraph. 17 (b) Iowa state university of science and technology shall 18 do all of the following: 19 (i) Direct expenditures for research toward projects that 20 will provide economic stimulus for Iowa. 21 (ii) Provide emphasis to providing services to Iowa-based 22 companies. 23 (c) It is the intent of the general assembly that the 24 industrial incentive program focus on Iowa industrial sectors 25 and seek contributions and in-kind donations from businesses, 26 industrial foundations, and trade associations, and that moneys 27 for the center for industrial research and service industrial 28 incentive program shall be allocated only for projects which 29 are matched by private sector moneys for directed contract 30 research or for nondirected research. The match required of 31 small businesses as defined in section 15.102, subsection 10, 32 for directed contract research or for nondirected research 33 shall be $1 for each $3 of state funds. S.F. _____ H.F. _____ subsection 1, paragraphs “a” and “b”, that remain unencumbered 1 or unobligated at the close of the fiscal year shall not revert 2 but shall remain available for expenditure for the purposes 3 designated until the close of the succeeding fiscal year. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill appropriates moneys for the fiscal year 2020-2021 8 from the general fund of the state to the department of 9 cultural affairs, the economic development authority, the Iowa 10 finance authority, the public employment relations board, the 11 department of workforce development, Iowa state university of 12 science and technology, the state university of Iowa, and the 13 university of northern Iowa. 14 The bill appropriates moneys for the fiscal year 2020-2021 15 from the Iowa skilled worker and job creation fund created in 16 Code section 8.75 to the economic development authority, the 17 department of workforce development, and the state board of 18 regents and institutions under the control of the board. 19 For the fiscal year 2020-2021, the bill limits standing 20 appropriations established in the Code for certain operational 21 support grants, community cultural grants, and regional tourism 22 marketing. 23 The bill transfers $100,000 of the moneys collected by the 24 insurance division in excess of the anticipated gross revenues 25 under Code section 505.7 to the economic development authority. 26 The bill appropriates moneys for the fiscal year 2020-2021 27 from the special employment security contingency fund to the 28 department of workforce development. 29 The bill appropriates interest earned on the unemployment 30 compensation reserve fund for the fiscal year 2020-2021 to the 31 department of workforce development. 32 Moneys credited to the state by the secretary of treasury 33 of the United States pursuant to section 903 of the Social 34 Security Act are appropriated to the department of workforce 35 -19- LSB 5011XG (9) 88 ko/tm 19/ 20
