S.F. _____ H.F. _____ Section 1. Section 321.208, subsection 2, paragraph d, Code 1 2020, is amended to read as follows: 2 d. A felony or aggravated misdemeanor involving the use of 3 a motor vehicle , other than an offense involving manufacturing, 4 distributing, or dispensing a controlled substance a felony or 5 aggravated misdemeanor otherwise provided for in this section . 6 Sec. 2. Section 321.208, Code 2020, is amended by adding the 7 following new subsection: 8 NEW SUBSECTION . 5A. A person is disqualified from operating 9 a commercial motor vehicle for life upon a conviction that the 10 person used a commercial motor vehicle in the commission of a 11 felony involving an act or practice of human trafficking as 12 defined in section 710A.1. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill provides that a person is disqualified from 17 operating a commercial motor vehicle for life if the person is 18 convicted of a felony involving the use of a commercial vehicle 19 in the commission of an act or practice of human trafficking. 20 Human trafficking means participating in a venture to 21 recruit, harbor, transport, supply provisions, or obtain a 22 person for the purpose of forced labor or service that results 23 in involuntary servitude, peonage, debt bondage, or slavery; 24 or for the purpose of commercial sexual activity through the 25 use of force, fraud, or coercion, except that if the trafficked 26 person is under the age of 18, the commercial sexual activity 27 need not involve force, fraud, or coercion. Human trafficking 28 also means knowingly purchasing or attempting to purchase 29 services involving commercial sexual activity from a victim or 30 another person engaged in human trafficking. 31 -1- LSB 5418DP (3) 88 mo/ns 1/ 1
